Listen, all I am saying is this! In a court of law, criminals, the most nasty criminals on earth have the right to look eye to eye at those who have accused them! It don't matter whether they were innocent or gulity they still have the right to look at them.

 

The KHSAA is no different! If a memeber school accueses another member school of a rule violation, than the member school who is accused should have the right to look at those schools who have accussed them.

 

Your upset at the wrong person or school or whom ever here. JC's at falt here. The very school you are defending. If someone accused me of stealing, I would just prove otherwise. If JC had all their paperwork together and this came up, all they have to do is go get this kids file and show proof. Nothing to it. Well apparently JC can't provide this info. They are the ones you should be asking questions to other than "Who called the KHSAA" "What were their motives for calling". Every coach in the state knows what is needed to be filled out for a student and if they move there then its VERY IMPORTANT that they have all their ducks in a row. Because IF and I mean IF they (JC) didn't have all paperwork in hand then its their falt that this has come to light. Not someones or some other schools falt.

IF JC had the paperwork in hand and somebody anonymously accused a transfer of obtaining the waiver under false pretenses, how would JC be at fault? Are schools obligated to investigate the work of the KHSAA or are they allowed to accept the necessary paperwork at face value?

 

The right to face one's accuser is a basic right of the accused. However, in this case the accuser is the KHSAA (assuming that there is an accuser), which is acting upon a tip. If the tip proves baseless then the tipster should be held accountable if the accusation was not made in good faith. If the KHSAA received the tip in September, then there is no excuse for it not to have already resolved this issue. How long does it take to confirm somebody's home address?

Any school accused of wrongdoing should be informed as to who made the accusation. If the alleged "whistleblowers" were identified so that they could be held accountable for their acts, there would be a lot less complaints filed with KHSAA.

 

I'm not saying this is a frivilous claim but, the process, as now practiced, makes it too easy to cause a rival problems.

 

If we merely want the truth, why would we not include the possibility that the accuser is merely trying to cause problems for another school? It has happened. All should be accountable and, if the complaint is found to be baseless, the accusing school (assuming the complaining party can be tied to a particular school) should be punished.

 

That would serve to somewhat "level" that playing field.

The school that the kid goes to is responsible for having everything in order before they allow this student play in any kind of sports. All releases from other school have to be in hand and on file. All paperwork from the KHSAA has to be in hand and signed. The KHSAA will send the school the release paper to the school of where the student is now going. If the school doesn't wait for this release then they are at falt. This is why you make sure everything is together before you allow a student to play sports for your school. Especially if they have moved there from another county. Every school knows this, every coach knows this, every adminstrator knows this. How this thing can continue to happen is beyond me.

I respectfully disagree. Obviously the reason for that is the KHSAA thinks that if the accuser is made public, there would be a lot less accusations. The KHSAA rarely will make the accused school any 'trouble' unless they have just cause to do so. If we think there are a lot of private school accusations now, wait until the KHSAA is not informed to prove them otherwise...

 

Side note: That's a BGP record. I defended the KHSAA AND private schools all in one post...

It's certainly frustrating being a player/coach/fan of a school going through this kind of mess. Even when you think your "ducks are in a row", all it takes is ONE person making a call to KHSAA. Once that happens, the issue will remain in doubt until a decision is made weeks and weeks later.

 

It definately throws a pall on the remainder of the season. Enough said...(taking the high road)

For the info I have The player is a sophomore and starts on the DL. The first day of practice the player got a wavier that allowed him to play in the 07 season. The KHSAA got a call in the month of September and were told that the player and his family were not currently residents of Johnson County. Although it would be kinda hard to make the four hour trip from McCreary County to Johnson County everyday. I know for a fact that the Player and his family ARE residents of the county. so it shouldn't be a problem taking care of the matter. The player, his family, and coach Matney with the support of the county are attempting to get an appeal. He should be back in uniform by Friday.

So, I quess that you are quilty until proven innocent when accusations of this sort are made to the KHSAA?:rolleyes:

I have thought long and hard about this and I can see where it probably wouldn't be a good thing for the KHSAA to name the accuers of schools. I do like the idea of a few posters though. So by your logic, if your neighbor is dealing drugs and you call the police to report them, you have no problem with the police officer knocking on the door and telling your neighbor "The guy one house down says you're selling drugs out of here and that you beat your children, you mind if we investigate?"

 

Would you want the local drug dealer to know YOU are the one calling the police and ratting them out? I didn't think so.

I am no lawyer, but I assume that if the accusations are groundless and either the student involved or JC believes that they have been damaged, they are free to file suit and that the identity of the accuser would be disclosed during discovery. Am I wrong?

Well I have had about enough speculation into what is going on. I am going to give my opinon of the whole situation as best I can because I need to get this off my chest.

 

Ok, JC is accused of using as ineligible player. We are all aware of that! Now, if JC is found to be at fault, (which I can't see that) than they deserve whatever punishment they recieve.

 

Now, I have a thought for you posters. It is obvious that someone outside of JC has made the KHSAA aware of the situation. They have accused JC of violating these rules, thus looking for sanction against JC. The KHSAA has informed JC of these alligations and given them a timeline to respond.

 

Well this is what I think! In a court of law the most hardened criminals have had the right to meet the people who have accused them of their crimes. The accused have the right to look their accusers in the eye. I for one believe that the KHSAA should have to provide documentation to the accussed of not only the violations but also who is accusing them of those violations.

 

I believe it is Johnson Central's right to know who has accused them of these violations! It is sad to me that other schools can hide behind the KHSAA when they accuse other schools of breaking rules. It is also sad the school or schools accusing JC does not have the character to make it known that they have accuesed them.

 

 

On most reports like this, which appears to hav been made annoymously, then the report is given to the school to investigate. It also appears that JC once they recieved the report did the right thing.

 

On being "fair" that is something nobody has ever accused the KHSAA of doing!

Read my last post and you will see that I have admitted that it might not be a good thing.

We do not need to use examples of behavior that is against the law. I do it sometimes too but it isn't good.

I don't know why anyone cares about the accuser. If JC has thier stuff in order than it is know big deal. If they don't, then they have a problem.

 

Quit wasting time on who accused who and just make sure JC took care of business.:irked:

It's like putting the victim on trial. Deflect the attention from the accused. I'm not saying Johnson Central did anything wrong. I know there have been whispers and this is fairly tame compared to other accusations. But any AD knows transfer paperwork has to be one of the top priorities of their job and you have to make sure everything is in order and get an OK from KHSAA before they can play.
