The initial report to police could have been misleading, similar to the Walmart shooting case. That could cause the reaction we saw from law enforcement, one that was certainly warranted. Still doesn't change the fact that those two types of guns sound nothing alike.

 

YouTube it. They might not have had one but there are ways to make them sound real or more realistic than normal.

I heard a guy on the radio today say that if it was a COs air gun it would make a louder sound.

 

I use to have a CO2 pellet gun when I was young, a pistol. Was no where near as loud as a real gun and you would have to be an idiot to mistaken the two.

What if you've never been around guns to know the difference? It the sound loud enough where a novice might say "huh, that sounded like it might have been a shot?"

 

Amazing.. If true I imagine those charges would eventually be dropped with an agreement of community service and a signed waiver that they will not sue the police dept.

 

What they did fits the disorderly conduct statute if I remember it correctly.

 

I doubt there would be a lawsuit, but I imagine if a plea is reached there will be an aggreement that the pd cannot be sued in the future. They just like to keep their bases covered in that sense.

 

As far as grounds for lawsuit, without knowing all of the details it could fall under the defemation of character, or harrassment catagory. Doubt that it would happen, but like I said, if a plea is reached the pd will want to make sure it can't come back to haunt them.

 

They have zero chance of winning a law suit. Zero. The police investigated and left it up to the prosecutor to bring charges.

Thoughts and prayers with Fern Creek, but man oh man really just fuels my fire in this thread more even with a fake gun.

They will be charged with 2nd degree disorderly conduct.

I think that is a fair assessment of the situation.

 

I don't think they intended to cause the reaction that happened, but the fact is it was their fault.

 

I would assume they will get some type of probation, and perform community service.

 

I would also like to see them serve more than a one game suspension.

I don't understand why people are arguing against this. Someone clearly heard something they thought was a gun shot and they were clearly carrying something that looked like a gun...do people think someone made it up and got lucky?
