I guess I feel similarly, but I have to think that if there was some suspicious type character that time of the night "lingering" as it's been proposed, I would definitely be armed, and I'd be more concerned about the well being of my family. I don't know if I would have gone outside, but if that would have been my decision, and someone lunged at me, I'd have shot him.

Ok so what if they owner had a dog, kid jumps the fence, dog attacks, and kills him. Owner at fault?

I won't pretend to be an expert on "castle law" but my understanding is that there has to be a threat. I don't see simply being in the yard as a justification. I think there's a case in TX now dealing with that where the victim was shot while running away.

 

I believe the TX case the owner wasn't charged and that was the controversy because he was running away but TX law has the right to defend property by lethal force.

One significant thing about this case is that the Louisiana legal system is the only state in the nation that practices civil law instead of common law.

This country would be better if it's legal system were more like Texas'

Two words that come to my mind: Panic and Remorse.

 

I think the guy panicked at 2am, maybe woken from a deep sleep and not thinking clearly. worried about his family's safety, and reacted.

I think he is now full of remorse for taking someone's life.

I can see that.

I know this may sound odd, but I like my laser sight, because once it's on you, there's little doubt what's next. Maybe this could have happened and helped the incident end better.
