What in heavens name is wrong in tighter background checks . If the person passes the checking process they will still get to have their playthings .

That isn't what's being debated here. It's the over-reaching about weapons like AK-47s and reimposing the Assault Weapons Ban including magazine capacities.

And ????
As I asked in another thread why should it be legal to have a high-capacity weapon? What is the value of them?

Secondly, does the Constitution make all weapons legal?

Since you asked several times and didn't get my point from my earlier post, I'll answer in simple terms. For me, the answer to your question is straightforward; you should want (not need) a high capacity magazine or high capacity weapon because you can have one! When politicians infringe on magazine capacity or ownership of military style rifles, they infringe on the Second Amendment. Period.

As far as your persistent question of need goes, CBDV covered it pretty well.

Are there illegal weapons today?

That's a good question.

I used to work with a guy that had a 50 cal. machine gun. It must be legal, because I can remember him waiting for his permit to come in the mail. So what's next, LAW rockets (Light Anti Tank Weapon) ) are they legal? :idunno:

Yes there are guns that aren't legal to the public. His .50 caliber machine gun isn't legal unless he has several different types of permits many of which cost a great deal(thousands of dollars) and take quite a while to obtain. It's possible he had a 50 cal gun that was semi-automatic that sounds a great deal more likely. Guns that are automatic or have sliencers etc are obtainable legally but it takes a long long time and lots of paper work to get those.

What's the value of having bigger, faster cars? Why should it be legal? What's the value of having the ability to go to a casino? What's the value of being able to buy and consume alcohol? Why should these things be legal?

Bigger faster cars= worse emmissions and worse fuel efficiency, just saying. Would be willing to wage a bet that more people are killed each year by people driving under the influence than firearms.

Seems like a dodge.

Yours or his.......

Just for clarification's sake it is more than "just a permit" since you also waive your right to privacy when you get a Class 3 license. The ATF requires you to get a license for the sale and acquisition of said weapon and a license for the ammunition. Additionally you have to keep accurate ammunition counts at all times in the event that the ATF wants to come in and audit you.

With the proper licensing most items are legal from what I read on the ATF's website and through their handbook.

Correct, the bigger you go the more in depth the look at you and the harder/longer it takes to be able to get the weapons and even the ammo. Realistically you're not going to see a lot of average joe's with the licensing necessary to own such weapons. The only real reason to have such a license is if you deal arms to wealthy people that like to use such weapons for recreational purposes.

That's your argument? Dodge? You use semantic deception applying "needs" to situations that more accurately require "wants". But you're not alone, this is the newest battle cry of the anti-gun crowd since they love to blame everything when something like the shootings in Aurora happen except what needs to be blamed.

The difference between the things you asked about and the things I asked about it the 2nd Amendment.

Unlike your examples no one is arguing "Constitution" like they are about the larger issue of weapons.

Is there a need for high-capacity magazines? Can the 2nd Amendment still be complied with if we outlaw them?

What do you consider high capacity? Also just because we don't say or mention the 2nd ammendment in every post doesn't mean that's not ultimately what it comes down to.

But what Clyde is asking is: would a specific type gun ban violate the 2nd? If so...other than "slippery slope" what is the reason against such types of legislation?

Does anyone truly believe that the nutcase in CO. would have not used an automated weapon if they were not legal? You can pass as many gun restrictions as you like but criminals will continue to break the law and find the weapons. The last time I checked Cocaine was banned but I'm sure people are still using this very moment.

The only way to stop people like this is to have swift and fair justice. This clown will bog our court system down for years and most likely will live out is fianl days waiting for the next appeal. Everyone is entitled to a day in court but our system has gotten way out of control.

Would this guy think of this elaborate plan if he knew that several people in this complex could possibly be carrying a weapon also. Do you think the common theif would have second thoughts if a slight chance that the victim may have a weapon as well.

Responsible people with weapons is the only equalizer. CRIMINALS do not obey the law, that's why they call them criminals. It's time we take a stand and make an example out of these sickos in the world.

Okay I'm off my soapbox.

But what Clyde is asking is: would a specific type gun ban violate the 2nd? If so...other than "slippery slope" what is the reason against such types of legislation?

As far as an out right ban of said guns I don't see how it would not violate the 2nd ammendment.

What you may consider a high capacity magazine and what I consider high capacity would probably be two entirely different things.

Magazine size or banning "Scary Looking Black Guns" is not the answer. Americans need to have personal accountability again. A 100% safe Utopian society can not be successfully legislated, there has to be personal accountability.

If guns were completely removed from this country then evil people would run around with high tech compound bows. Outlaw all foreseeable weapons...then watch when someone puts fertilizer and diesel in the back of a cement truck to blow up a Walmart on Black Friday. Evil people like the Colorado shooter will not be stopped by legislation...just by a needle.
