Swarbick is a very smart man, who is very familar with law. I'm sure he is aware of what he is doing, and didn't just make something up. Unless you were there how can you say he is making it up?

I was told that the kid filming was not part of the football team but, rather, he was part of a class or group that films. If true then that's out of BK's control.

 

Pretty much every team tapes their practices right? Some big schools even have permanent structures where students tape them. My guess is this film class has something to do with the team. The Tressel press conference Tuesday gave me chills when he said we have to worry about our kids being in the air if it's windy. BK made a bad decision to practice outside and to have the kids go up to film it on a temporary structure. My understanding is there was another kid on a different one at the same time. I'd love to hear his comments.

Kelly failed in the worst way possible.

 

In recent years, Notre Dame dismissed Bob Davie, Tyrone Willingham and Charlie Weis for failing to win enough games. The school canned George O’Leary for exaggerating on his resume.

 

Those "crimes" pale in comparison to allowing student managers to go up in 50-foot-tall lifts to film practice in hazardous wind conditions.

This situation is such a tragedy. Not only did a young man lose his life in an unnecessary way, Notre Dame is now trying to cover it up. A sudden gust of wind? I guess all of the weather reports that day meant nothing. It's pathetic. I hope that who ever is responsible for this pays the full price for it, because this kid didn't have to die. BK is a slimeball and given what the administration has pulled so far after this incident they're not much better.

Do you really think a man with the brains and legal knowledge of Jack Swarbick would really attempt to try and cover this up? This guy isn't some idiot. I actually heard him say they are just going to let the investigation play out. You guys are all looking at what he said the wrong way. Trying to "cover this up" give me a break.

Thank GT. This is a great article, and really painted a better picture of what happened for me. I'm glad you are able to use the tragic death of a student, to exploit BK because of your long and connected background with him.

 

The direction your going with the post on this thread is so obvious it makes me want to puke.

I agree with those that say they need to take their hatred for ND out of this. The horrible accident is not the fault of the entire university or athletic department.

 

BUT, first the reports from South Bend said the team kept practicing until about 30 minutes after the accident. Now the claims are they did not? Kind of odd?

 

The kid tweeted "Gusts of wind up to 60 mph. Well today will be fun at work. I guess I've lived long enough" before he went up? And "Holy (blank). Holy (blank). This is terrifying" just before the accident? YET ND officials are now saying it was a "sudden gust of wind? When there were high wind advisories? I don't buy it!

 

Not saying BK personally told them to go up and film in the high wind, what adult is responsible to tell them to go up, come down, or not to go up? You can't tell me out of all of those people at practice that during the winds no one looked up at the towers? The team practiced inside the day before so BK must have decided they needed an outdoor practice regardless. Someone is responsible for saying the winds are too strong and we need to get them off the towers, if no one else said it, it goes back to BK. I am sure someone said something like "we need to get films today", as well as someone at least thinking about the towers in the high winds, again it goes back to BK.

 

Other college coaches saying they have to worry when their kids when it's windy.

 

Regardless of whom the kid worked for, a film department or the football team, he was there on a ND tower, on the practice field, filming a football practice! There lies the blame on some coach.

 

When GT started this thread, he said it's not going to end well for ND. The more ND talks, the worse it will look on them. Just admit the kid shouldn't have been up there, they are going to get sued either way, just don't switch the blame off on someone else, or a sudden high burst of wind on a calm day, it will only make them look worse.

The "cover up" crowd needs to give it a rest. We talking about a situation with 100s of people in the vicinity, it is not as if there are no witnesses. Some are having a difficult time differentiating between their dislike of a team and individual on the sports level and translating it to the real world. I can fully understand if Kelly or others are let go (or even prosecuted), but I am not attributing it to Kelly being a jerk on the sport's level.

So do we ignore the coaches that directly stated they would be moving practice indoors because of the risk of the young men running video on the towers the day before? Do we ignore BKs incessant whining for a bubble at UC to practice out of the elements in situations like this? What else should we ignore to remove blame???

I really feel bad for all involved here. What a terrible, terrible tragedy. My heart goes out to everyone.
