October 22, 200916 yr That had to be a hard one to see unless she was right at the window.Never mind. Edited October 22, 200916 yr by Run To State
October 22, 200916 yr That is just stupid. If she was so horrified, then leave the yard. Why walk through the yard, allowing him to follow her and expose himself? Give me a break--don't look in other people's houses!!!
October 22, 200916 yr It seems there are two different accounts. She is saying it was around 8:30, which would mean the sun was up, but he is saying it is 5:30, when it would still be dark. Who knows? I hadn't heard that. That makes quite a bit of a difference, doesn't it?

October 22, 200916 yr Doesn't make much of a difference to me. I'm inclined to agree. You should have privacy in your home. I think the only thing that would make much of a difference is if he were doing it in deliberate view of a public place, but it sounds like she was in his yard. Then again, I don't really get the point of indecent exposure laws anyway.
October 22, 200916 yr I think he'll come out OK in court because this will surely end with a hung jury.

October 23, 200916 yr Well, we certainly don't know how she came to see him. However, lets assume she was cutting through the yard as described, saw him, was shocked, kept walking, and he kept moving along with her with his genitals exposed. I believe almost every state has a statute that would cause him to be charged. If he had been standing there stretching, she saw him, she was shocked, kept walking, and he didn't move from room to room then my guess is you have nothing. I read the KY statutes and the intentional display portion seems to be the key and answers my previous questions. Nothing like a couple of sets of toe touches or jumping jacks in the morning.
October 23, 200916 yr Doesn't make much of a difference to me. If he could see them and walked from room to room so that he kept in her view I think that makes him look bad. At 8:30 that is possible, at 5:30 I don't think so. I still don't think he should have been charged with anything.
