I'm not disagreeing that killing someone as they sleep is right. But, I'm vehemently disagreeing with the "they can leave, they need to understand that" part of your statement. I urge you to go to your local women's shelter and volunteer. I urge you to do some investigation into Battered Women Syndrome. It's not as simple as you are seeing it. Please, do look into it.

Rockmom my post is wrong. I was just reading what I said. I meant to say that they can't leave. I said in another post that my older sister was in an absusive marriage. The piece of crap guys would run their mouths to myself and my 2 older brothers and my dad. They could run their mouths on the phone but They would never face my 2 older brothers or my dad. Men who beat on women won't hit a man!

If you abandon the home, that is prima facie evidence to be used against you in a custody battle. Does she take the kids? Change schools? How does she get money? And the "there are programs" response doesn't cut it. There is no duty to retreat in Kentucky and I know you agree with that law.

If he was awake and the abuse was occurring, I know that you would be in favor of her blowing him away. So what we are arguing is the fine line of temporal proximity to the abuse occurring.

If you are her, and you KNOW that when he awakes you are going to be beaten, you KNOW the police won't help until AFTER an event, and your children are in the next room and you're not going to leave them, will you not concede that there are some emotional and mental states that would cause one to take care of business before he awoke?

I have seen where one letter changed what I said. This what I meant to say when I said "They can't leave, they need to understand that."

I know I said they can leave but I meant to say "They can"t leave, people need to understand they are afraid to leave or they can't leave"

Afraid to leave doesn't = can't leave. They can, they just need the courage to.
If you have seen too many times of the spouse getting killed, how many times have you seen it where the restraining order works, the wife moves out, goes to court, custody is decided, they get divorced and nobody gets killed in their sleep? I think that happens a lot more than what is highlighted in the media. We have a court system for a reason.

You are correct. Most of the time a restraining order works. But the one time it doesn't is one too many to me.

So you are back to saying if you are abused, just pop a cap in the guy and it is OK?

Will this case change how the Ft Thomas please respond? If I remember correctly, this case was not handled well as far as the initial reaction. Lost logs of people entering the scene. Moving the body. Possible contamination. Camera had the wrong date and time on it. I may not be clear on all of the problems but the perception I had is that is was not handled well.

My first reaction to this was that its simply a case of not having experience but then someone straightened me out pointing out that's their job to be ready and to handle it properly.

I guess asking the folks of Ft Thomas to be critical (constructively I might add) is tough since it would be of friends, family, and neighbors.

I get that.

Quit talking to yourself.

Not the first time nor the last, my friend.

Stop posting and get those taxes finished.

Just sent 4 out the door. Gonna take the rest of the night off and hit it again in the morning. It's Miller time.

Just one more reason I like you.

Not to mention that there's nothing to be critical of.

Yes. Why should self-defense change just because its physical spousal abuse?

Better to be judged in a courtroom by 12 then carried out in a coffin by 6.

Not to mention that there's nothing to be critical of.

Of course there isn't.

Other than the items I listed.

I'm going to have to admit, I'm thoroughly shocked, and frankly disappointed, that some can't see the effect of domestic abuse on the person being abused. I'm completely convinced that many have never explored BWS, beyond what they read in newspapers. And I will tell you, the answer "just leave" may be the most naive answer to any issue that I've ever heard.

To be totally honest with you RM, I know several women that were victims of such explosive marriages, some of them are relatives. Some of them stayed and continued receiving the beatings, a few of them gathered themselves and said ENOUGH. They left that pathetic situation and that was the end of it. Sometimes, it takes finding that courage deep inside of yourself to say, that's it, I'm not taking anymore of this. It can be done, I've seen it. In these cases, "just leaving" was anything but naive, it was their freedom.
