Me too. Wonder how this will play out. Sounds like she tried to get some type settlement and Simon says no. Maybe Simon doesn't ever hear no.

The article makes it seems like a rape kit was done the same night the alleged assault took place but not reported to police until 4 days later. Am I reading that right? Don't the police have to be notified if a rape kit is completed by a hospital?

So there is not enough evidence for him to be tried in a court of law, yet can still try and sue him? I love America!

Also if you are in a state where you can't say no, you most likely won't be able to remember what happened to you... I really hate this trend of people frivolously calling rape on athletes.

Really? You read that article and think there's no way he did what was accused? I am not in any way saying he is guilty. I am saying I'd hate to say she is frivolously calling rape on an athlete and be wrong.

I didn't read the article but will state my opinion on the subject (and I may get bashed for this by women)...

 

I don't think the woman should be allowed to file a civil suit like this under the name Jane Doe. It's not fair for Mr. Simon to have his name plastered around town now as an alleged rapist. He is entitled to due process and to be looked upon as innocent until proven guilty. JMO

As gross as it sounds, I think if he struggled to enter her vaginally, I'd think the way they portrayed it would be even more difficult if she put up a struggle. Again, if he's guilty I sure hope he gets what's coming to him.

 

And I read it again, and it sure sounded like she waited 4 days and the "advocate" advised her she didn't need evidence at the same rate in a civil suit. Not enough info in the article, IMO, but what's there sure seems suspicious.

I find it out that she was 'visibly intoxicated' when leaving the club, but then has perfect recollection of the events following.

 

Don't get me wrong here, if the guy raped her, I hope he gets what's coming to him. But the whole 'I was drunk' thing is bologna.
