NKY Wife Convicted of Murder Asks For New Trial

Featured Replies

The thing that has me wondering is the earlier call to the cops that was diffused by the mom and kid. They meet the cop in the street and said nothing was wrong. She shoots him in bed the next day? Did she have a day to think about this and would that be premeditated?

Or maybe....

She knew she would be in huge trouble if the police were brought in so she did what she could to make them go away. Sounds like it wasn't enough though since she claims that later that day he told her either she kill herself or he would kill the children. Mind games can do real damage to a victim of DV; especially if the emotional abuse has gone on for awhile.

Just spitballing here like everyone else.

BTW - did the prosecution ever come up with a solid motive to explain why she killed him?

Apparently there was enough of a motive to have her convicted of murder.

Obviously. I just never heard what their motive was.

If someone can provide concrete proof that abuse was going on, then this discussion is different for me. The jury sat there for two weeks and listened to all the facts and examined the evidence brought before them. Not one ounce of evidence to support any abuse taking place. My big question............why could not ONE shred of evidence be discovered? Seems odd to me. Yet many here are making the leap to assume that this murderer was being abused. You have simply a living person's word vs. a person from the grave who has no voice. Gotta believe if abuse was happening, there would be at minimum some semblance of evidence. What if she shot him because he had met someone else and wanted out?? We will never know.

Behind closed doors, we do not know what happened. I also believe that she took the stand in order to avoid having the kids testify.

Many believe she took one for the team.

I think in this case there are many indications that abuse may have been present, but no external agency documentation.

Who knows what would have happened if Ft Thomas PD had followed through the day before rather than turning away....we could be talking about the exact opposite situation.

With the wife turning the police away the day before it allowed her to play judge, jury and executioner.

Since when did law enforcement, on a dv call, ever allow a citizen (and a female at that) to turn them away ?

I didn't have to go to the academy to understand that you probably need to see for yourself or at least talk to the other party..in particular if one of the parties meets you up the street from the call origin.

It would seem the equivalent of not responding to a 911 call because someone on the other end said "oops - no worries - we're good."

You should know that Ft Thomas is a pretty small town, and there's a likely chance that the McCafferty's may have known the responding police officer. If that it the case, that I am not surprised in the slightest that the officer was fine with taking Cheryl's word and not reporting the incident.

It explains it but it doesn't excuse it.

That totally goes against protocol for a DV call.

Intimately familiar...I think that you have hit the proverbial nail squarely on the head...

I was never trying to excuse it, or trying to argue that the office was following DV protocol. I was explaining why I am not surprised it happened.

Either way you look at it, it could have been Cheryl planning the murder of her husband and she knew if she let the police in that would disrupt her plans.

There is plenty of blame to go around but no one can deny the last sentence is one possibility.

We could spend the rest of our lives speculating on why Bob McCafferty is dead.
