May 29, 201313 yr Cheryl McCafferty is serving an 18-year prison sentence for the shooting death of her husband Robert in their Fort Thomas home in 2007. At a hearing today on her bid for a new trial, it was McCafferty's former lawyers who were on trial. Cheryl McCafferty says she had ineffective counsel who didn't paint a clear picture of her situation. She also claims they got her to sign off on a sentencing agreement that she didn't fully understand. All the key players were back in court today, most playing much different roles. McCafferty claims she got ineffective legal counsel who used a self-defense approach instead of a battered spouse defense. On the stand, she said she didn't know what she was getting into when she agreed to waive her rights to appeal in exchange for an 18-year sentence with eligibility for parole in just two years. "Because the jury was precluded from hearing all the domestic violence incidents to them, they were only able to hear about that night. To them, they just thought I woke up and decided to shoot my husband." Cheryl McCafferty was denied parole after a full hearing in 2011. She is up for parole again in 2016. May 29, 201313 yr Author Since the article does a poor job of telling the whole story I have a couple of questions for anyone in the know. Who represented McCafferty? And, if she had eligibility for parole in just two years why was she denied a full hearing after two years?
May 29, 201313 yr She was denied a hearing because the state went back on their word. They said if she pled guilty, they would not block any attempt to request parole after the 2 years were up. At least this is my understanding of the plea deal from what I remember. I hope at the very least, that Cheryl gets a new trial. I also hope the Enquirer is victorious in their pursuit of Ft. Thomas documents that should be public record. Those documents could help Cheryl's case immensely.
May 29, 201313 yr Perhaps she should of thought about all of this before pulling the trigger and committing cold blooded murder.
May 29, 201313 yr Since the article does a poor job of telling the whole story I have a couple of questions for anyone in the know. Who represented McCafferty? Deanna Dennison
May 29, 201313 yr Author Perhaps she should of thought about all of this before pulling the trigger and committing cold blooded murder. I am not making any statement or offering any opinion about that, just dealing with the current "issues."
May 29, 201313 yr Author Deanna Dennison I certainly look forward to Deanna's colorful responses on this issue.
May 29, 201313 yr Deanna Dennison This chick is a "whack job". She's the female version of Eric Deters.
May 29, 201313 yr Author This chick is a "whack job". She's the female version of Eric Deters. I have had cases with Deanna and in my experience she is not a whack job.
May 29, 201313 yr If her plea included a clause that would not let her appeal, than what is the issue? She did not understand what she was getting into? Give me a break. She thought she might walk in 2 years and now that she won't know again until 2016 she changes her mind? Give her a new trial, now that she has already pleaded guilty the first time, can they use that as evidence in the murder case?
May 29, 201313 yr Perhaps she should of thought about all of this before pulling the trigger and committing cold blooded murder. Do you see any valid reason for a wife to shoot her husband while he sleeps? Is there any amount of abuse that justifies it?
May 29, 201313 yr Perhaps she should of thought about all of this before pulling the trigger and committing cold blooded murder. Perhaps he should have thought about his wife eventually shooting him dead if he kept abusing her.
May 29, 201313 yr Perhaps he should have thought about his wife eventually shooting him dead if he kept abusing her. Let the law handle the abuse. Thats' why we have police officers and a judicial system. If you let citizens take the law into their own hands and murder someone, you had better be prepared to spend some time in jail when you get confess to the murder.
May 29, 201313 yr Do you see any valid reason for a wife to shoot her husband while he sleeps? Is there any amount of abuse that justifies it? I don't know. Abusive men abuse not just physically, but mentally. Abused women live in fear all the time. Maybe she had taken all she could and waited till he fell asleep so he could not overpower her. I am not saying this was the case, but sounds like it was a possibility.
May 29, 201313 yr At the time I did not see it this way, but everytime I read an article on her doing this - I thank God. The reason - Cheryl dumped me via a Dear John letter like 30-31 years ago! Seriously Only time a girl dumped me. Well, that part is not serious, but the first part is the honest to God's truth.
