Did a teacher from Highlands get fired for inappropriate communication with a student

Featured Replies

Is it? If so you're right as to the authorities being involved. I would think it would be a closed legal matter once it's determined that nothing took place prior to the student turning 17.
I agree. If the student was a consenting adult at the time of the alleged activity, then this is an ethical and school policy issue only.

A. Why have the teacher/student issues become so prevalent nationally lately?

B. Where were these teachers when I was in school?

They definitely were NOT "up on the Hill" when you were there. I've got about 10 years on you, when I was there there was an Art teacher that was pretty hot.

I could be wrong, but I believe Kentucky State Law makes it illegal for teachers and individuals in any similar authority position to have any activity with students even if they are of a consenting age. I'll do a little digging on that, but I think that's the case.

Well, in that case, I guess it is a problem.

Found it. Looks like it was originally signed into law in '08. They've had some arguments about how constitutional it is on the basis that it's "position of authority or position of special trust" is somewhat vague, so they apparently have clarified it a bit further and whatever clarification was made (I couldn't find it in text) was signed into law just this past April.

KRS 510.110: Sexual Abuse In The First Degree

(1) A person is guilty of sexual abuse in the first degree when:

(d) being a person in a position of authority or position of special trust, as defined in KRS 532.045, he or she, regardless of his or her age, subjects a minor who is less than eighteen (18) years old, with whom he or she comes into contact as a result of that position, to sexual contact...

I believe that there is a statute on communication as well.

Specific to where, when, and how a "person in a position of authority or position of special trust" can communicate with a person under their authority/trust?

For what it's worth...I know a LOT of teachers, and hardly a single one of them has their straight up name on their Facebook profile.

Everyone that I work with does, myself included.

I guess people are too quick to post tnat they don't read what was already posted. A couple of hours ago we were posting in this thread of how if you are in a position of authority it doesn't matter if the kid is of legal ago or not. ;)

Oh, trust me, I COMPLETELY understand why you would want to do that. I was just mentioning it because I couple of fine gents on here were discussing their troubles finding her on Facebook.

Ohhhhh, I've been known to skim from time to time. I've learned from reading job specifications day in and day out that there are certain things that I'm just not interested in reading. I guess that might mean I could miss something of importance from time to time. :D

Violation of this will result in the intitation of proceedings to suspend the teaching certificate.

Recently Arkansas struck down this questionable law. Saying that alll adults have a constitutional right to engage in a consensual sexual relationship.

I don't like it. It is a slippery slope. I believe that college professors can get canned for this as well. You shouldn't meddle where you have a fiduciary duty to the other party. There are too many conflicts of interest. If it is true love, (can't say that I see how) and not lust, wait. Graduation dates come and go.

So it doesn't apply if the person is over 18.
