Also, for what it's worth (I know the matter is a little off topic), a few years back I was shopping at the local mall and noticed a kiosk selling shirts & sweats with local high school names on them. I walked over and started checking to see if they had anything for Cov Cath. The salesman asked me which school I was looking for, and when I told him, he handed me a petition to sign because apparently Cov Cath has asked his company to cease selling anything using their name. The petition just didn't seem to pass the smell test to me, so I declined and went about my way.

 

After very little research into the matter, I found out that Cov Cath had in fact asked a handful of local companies to stop selling apparel using their school name. Although the companies do make "donations" back to the schools based on the revenue they are making, Cov Cath puts a lot of time, effort, and money into making their own apparel, and they make a surprisingly sizable amount of money by selling it to the Cov Cath community themselves - certainly more than they would get back from the clothing companies.

 

Those profits all go back into the school - primarily to fund the less lucrative athletic programs. Let's face it, for the time and money that is spent on a track team or a baseball team, they're just not going to have the ticket sales that football, basketball, or soccer are going to get.

Actually, Wisconsin DID ask Wayne to stop using the logo. Obviously, according to eyewitness account from spindoc, they either backed off or reached an agreement.:idunno::idunno:

Doesn't Wayne have a cardinal now? I know South Floyd used to or still uses the 49ers SF. One of our middleschool teams in Harlan are the Patriots and I personally have spent a lot of money on New England Patriots stuff. Was it Pulaski Southwestern that used Florida State's arrow on their helmets. This is so crazy, if it comes up I would bet my life it will have to do with money.

I still say that IF there is a copyright infringement, it comes from the vendor, not the school. It has to be ordered from someone who is making it. It is not up to the customer to have to work out these details. Bottom line: If someone is producing it, and making money from it, they are the ones responsible for making sure no toes are being stepped on. Schools are ordering online, out of catalogs, from salesmen, from...well, somewhere. They are not producing these logos. Once in use and having t-shirts and such made, there could be a situation for the school. But someone other than the school is producing the helmet decals.

What gets me was when I was young in little league baseball we had the Reds, Tigers, Braves, Pirates and so on.

 

When my son played they had to stop because MLB wanted to charged the rec programs a fee to use their name and logos on the hats given to the playes. This is very sad that greed has come to this.

 

I'm heavily involved in a local Little League, and we use replica jerseys for all our teams. Actually, MLB gets their money back through the manufacturer, not the leagues. Recently, Majestic took the coveted spot of exclusive manufacturer for MLB wear (away from Russell - a darn shame because Majestic's quality is nowhere near Russell's...), so - when you buy replica jerseys from Majestic, you pay a little extra that goes to MLB...

Some of the Cov Cath's mascot logos (including the one I have on my profile) are borrowed from Ole Miss. Their helmet design is original though.

Last year I heard that Bell County had to get special permission from UK to get their CATS logo that is on their helmet used in there championship rings. It took about 3 extra weeks to get that done. UK had a patent on CATS.

All my life, I've enjoyed looking at how the high schools use college fight songs and logos for their sports teams. Sometimes, schools use things from multiple schools!! I remember going to see a Nelson County football game and noticing that the logo painted on the field and buildings was the U of L Cardinal head; the "N" on the football helmets was the Nebraska Cornhusker helmet logo, and the fight song was UK's...

 

Now I'm hearing from some athletic directors that some colleges are threatening to take some KY high schools to court for using their proprietary logos. IMO, this is shameful and reflects poorly on the university in question. What possible harm could be done to a university by a HS using their logo? I'm very well versed on copyright infringement, and I simply do not see the damage that the HS can do. In fact, I believe this can only be beneficial to the college in question.

 

Has anyone else heard about these threatened lawsuits? Anybody know of one that has actually gone to court? What do you think? :ohbrother:

 

Last year Nelson Co. used the UofL Cardinal logo on their helmets, but they have switched this year to an interlocking NC similar to North Carolina's, which you can see here.
