Mauk suing the NCAA

Featured Replies

I live life by two rules:

1) Never believe any lawyer speak. "Virtually identical" means not similar at all.

2) There is nothing I enjoy more than getting you riled up little buddy. ;)

1. Agreed.

2. The feeling is mutual... :p

1) At least you agree with me about the lawyer part, no one can argue that! LOL

2) Thats why we get along/fight so well!

Quitter...

Hey easy on us lawyers.

But.. arguing something is "arbitrary and capricious" = YOU LOSE.

 :thumb:

If Ben wants to sue anyone it should be Wake...not the NCAA.

I think the fact that he is suing the NCAA underlines the fact that he just wants to play one more year and isn't in it for money.

They will be well into the season by the time this ever goes to court.

Goes to court a week from tomorrow...

I think I will use a GT classic to describe this situation- "Denial. It is more than just a river in Egypt"

In all seriousness, I guess I'd be doing the same if I were in his position. At this point, though, is the NCAA going to back down. It seems like Mauk has exhausted a lot of options, why would they suddenly allow it?

There are a few precedents that fit the case that got the 6th year, and at the end of the day Ben wants the chance to state his case. The difference is he has no real shot because his HS injury trail stopped when he got to Wake because he wanted to compete for the job and didn't let on how bad he was hurting.

No matter how it goes I think the chances are less than 1% he plays for UC this year. With that said, I can't blame him for his decision...

Your a lawyer?

I do not blame him one bit, do everything possible young man.

“I’m sure every kid who gets their thing overturned, the first thing they think of is ‘I’m going to sue them,’ " Kelly said. "He’s got to do what he’s got to do. I’ve got to coach my football team. If it gets overturned and he’s free to play, sure, but that’s nuts. It’s not even worth me spending time on.”

Well not completely. Graduated in May and sat for the bar exam a couple weeks back. Results come out the first of October.
