See, that's the difference between the classroom and the real world. So maybe it isn't the marijuana smell, maybe the policeman saw the suspect take his hands off of the steering wheel and reach beneath the seat. If they are successful most of the time, and the good cops can tell when that should be their story (and don't get me wrong I'm glad they do) what is going to happen to them? The thing is the good cops know when to make sure they search a vehicle and when not to. You can't search them all but when you know that you should there are plenty of outs as to a reason why.

I agree with respect to Henry's specific situation for which he received a traffic citation. I was responding to your general statement that "police need to have probable cause to search someone or their vehicle." This is not necessarily true. American courts have long recognized a police officer's authority to conduct a warrantless search incident to a lawful custodial arrest. In fact, there are several exceptions in which officers can conduct searches without a warrant and even without probable cause: consent searches; emergency searches; motor vehicle searches; inventory searches; and searches incident to lawful custodial arrest.

I realize that there are SOME searches that police can do without warrants and without probable cause, (I mentioned consent already) but most of the time if police are doing searches like an emergency search, they're not supposed to be looking for evidence against a particular suspect, are they?

When a player like this is involved, I would bet the house on it that there are many issues behind the scenes that the general public knows nothing about. I agree 100%:thumb:

If he were arrested there would be a record of it. It would be public record. There is no way he could have been arrested and the media not find out. Even in Cincinnati the media isn't that bad.

I would venture the general public would be stunned to learn how much contact that the police have with a guy like Henry. Most of these contacts don't involve an arrest, but goes to show the type of individual that person is. Most decent law-abiding persons have bare minimal contact with the police - maybe a traffic ticket here and there. I'd be willing to bet Henry hasn't gone a month in the past 2 years that he hasn't been approached by the police for some reason.

Someone may have already reported this; but the Bengals cut Henry from the team today.
