You actually think that Dale Sr. thought about his company and said "hmmm I think that my wife, who has no clue about nascar and how it's run, is better capable to run it than my flesh and blood son who I'd do anything for and probably was going to get the company anyway"?. I think by wanting 51% ownership of the company he is focusing on racing and he is trying to do whats best for him as a driver. DEI is not producing the same equipment that the Hendricks, Rouschs and Gibbs are. I think for Jr. to be a Champion he needs to get out of DEI or get the majority ownership. I just dont see Tereasa giving it up.

Please also note that it was not only his company. She started it with him a couple years before they were married. So you have business law of partnerships or whatever legal form the company was formed under, estate law concerning marital assets, and his will. Each one directing the company to her. I would say he was very clear who he wanted the company to go to. There are also other children involved in the equation who have just as much right to it as Jr. Personally I hope she offers to sell him some of the company but she is not obligated to and she certainly deserves what she has.

Junior is a young man and has plenty of time to be an owner. If he thought like an owner he wouldn't have totaled about $500,000 worth of cars Saturday night.
