The gun would still have to be cocked, (for it to "Just go off") and pointed at people. Both of these are major gun safety no-no's.

  • Unless Baldwin tampered with the gun and/or put real ammo in it I don't see how he can be charged with anything.  Now civilly the movie company it going to have to empty their pockets.

Also from the article it was a new grand jury, he faces 18 months in prison, and there is a lot of back and forth detailed in the article that doesn't make the powers that be look good in New Mexico but either way they have a new finding and have charged Baldwin.

The jury found Hannah Gutierrez-Reed not guilty of tampering with evidence.

Baldwin being found guilty will not make sense.

For me it comes down to a couple simple questions:

1. Are live bullets used in guns on movie sets?

2. Is there any reasonable expectation by an actor that a gun on a movie set would have live rounds in it?

1. My understanding is that live bullets were there because the actors were wanting to compete against one another in quick draw and other shooting competitions when not filming. Pretending to be Cowboys they all wanted to see how good they really were.

2. Rule number one in every gun safety class, is to always assume a gun is loaded and ready to fire. So if they had been target shooting with live rounds you absolutely have to understand that there could be live rounds in the pistol.

Even a blank can cause serious injury or death if fired to close to someone's head.

Additionally, the case has been dismissed with prejudice.  From the Great Google Machine:

In the legal area, a case that gets dismissed with prejudice means it has been permanently dismissed. No matter the circumstances, if a case is dismissed with prejudice, it cannot be brought back to court. The case is done. Alternatively, a case dismissed without prejudice means the case can be brought back to court.

I wonder what this means for the Hannah Gutierrez-Reed conviction.
