Student Athletes are School Employees

Wow! Imagine a "wildcat walkout" players strike at about 3pm on the day of the national semifinals! Or even more dramatic, the weekend of all the conference championships or big rivalry weekend. Be interesting to see how NIL agreements would be affected by "non-performance".

National semifinals shouldn't be a big deal. Season is usually over by that day anyway.

Who's going to pay the inevitable union dues for players not making bank on NIL?

If they are considered employees then all compensation would probably be taxed as earnings, including scholarships. I know this idea was in the news recently.

Scholarships are not taxable in 99% of cases.

This is all great for the top dogs, but we are slowly destroying the DII and DIII programs for athletes that want to continue a career but are not DI level players.  Small schools will not be able to sustain athletic programs.

There will still be kids who need a place to play, knowing they aren't going to the next level and not going to make much (if any) money to do so. They will be fine. Water always levels out.

Sounds like this tweet is off.  The NLRB favors making student athletes employees, they don't have the authority to declare.  So far the, the Supreme Court has said student athletes only meet 3 of the 4 requirements to be an employee.  They have said student athletes do not meet the requirement that they work in the primary industry of the company.  For colleges, that is education and research.  Some are arguing that the amount of money athletics brings to colleges helps fund education and research so it could be argued that student athletes actually are actually part of the primary industry.

You mean it wouldn't be a big deal if those two games DIDN'T happen? I'd think NCAA and TV would have a major meltdown lol.
