Drivers Who Hit Protesters Purposely Blocking Traffic Are Immune From Civic Liability

Featured Replies

From the first paragraph:

"The bill says a driver would not be immune from civil liability - if the actions leading up to injuries were willful."

Serious question. Are some of you saying that you would willfully plow into a crowd of protesters? Is that where we are on this? Am I reading that sentence wrong?

If I am in my car and surrounded/blocked by any "mob" and I feel threatened I choose my life over their lives.

If it is an emergency situation and I need to get to a hospital, you best not be protesting that day.

Hard for even this diehard liberal to disagree here. But I would try to play nice first. For a little while.

I'm curious...what would be your tipping point?

- Protesters just blocking road

- Protesters start walking towards your stopped vehicle

- Protesters surround your vehicle (but not touching it)

- Protesters start pushing on your vehicle

- Protesters climb on your vehicle

- Protesters throw things at your vehicle or start breaking your windows

- Protesters try to open your doors

Somewhere in between one or two of these?

Would the resulting damage to the vehicle be covered by collision or comprehensive?

That's exactly what prompted the legislation. Couple couldn't get their sick daughter to the hospital because the road was blocked with idiots.

Yes. That's when I move.

I am probably somewhere between 3 and 4...

And to be clear, much of my position on this was formed 45 years ago. I've told the story before.

I had kicked a kid out of the community pool (my summer jobs were almost all of the lifeguarding variety). He waited until I got off work, hopped on his bike, got in front of the car I was driving and proceeded to inch along as slowly as he could while keeping the bike upright. After a short time I told him to move or I would run him down. He didn't, so I gunned it and hit the bike. He jumped off and I crumpled the bike.

Didn't take long before I realized the stupidity of what I had done. He was no threat. All I hd to do was put it in reverse and go a different direction.

I bet he never tried that crap again with anyone else though.

Okay, thanks. I'm pretty much there with you, with one exception. If I've got my family in the vehicle with me, those protesters start walking towards me, I'm looking for an out. Guaranteed the engine will be revved up to let them know I mean business should they continue.

That's fair.

And for any law enforcement people reading this thread, you need a policy on how to handle an incident like this and part of that policy should include locking every one of them up and charging them with every felony that applies.

Most of you don't realize that it says you may not face civil suit unless your act was willful. Criminal charges are another story. There is a real fine line here.
