How friendly are you with your previous CPA? If he or she will give you their insurance information, make a claim with the insurance company for your loss. It won't cost you anything but the time it takes to make the call and send them the documentation.

I'm sorry this happened to you the IRS is a mess. But after reading this thread and the time that elapsed I'm confused why you did not just consult with an attorney.

As I'm in the middle of trying to figure out how to pay for 2013, I just received a letter from the IRS saying I owe $3,756 for 2014. At this point, I'm considering a single gunshot wound to the head.

 

And I can't do an Offer in Compromise because I have a job and income. I'll probably lose my home over this.

 

I'm pretty much tired of even doing good deeds. What's the use to even try doing the right thing when you just get crapped on anyways?

Why are you so against seeking FREE legal advice on whether you can sue this tax preparer for negligence? Isn't it worth saving your home for??

 

It has been a while since I have done anything with taxes but I have to assume fees and interest levied by the IRS ARE NOT deductible so it is not like you will be able to recover some of this on your 2017 return either. I cannot stress enough how much you need legal advice right now.

How could it? The worse that could happen is the attorney would say you have no case. If you and your attorney do sue and you lose, the whole "We don't get paid until you do" part comes into place. While it may cost you a little time, no money will come out of your pocket.

You should either be able to set up a payment plan, or basically give up your tax return the next couple years and take care of it. Hopefully neither of those would cause you to lose your house.

I've had a couple issues with the IRS and both times this is what I did. At least in both my cases, they set up a plan to get everything paid up in 24 months, and with other refunds, my past due got taken care of pretty painlessly.

 

Pay as much as you can afford now and make an arrangement for the rest. Based on the numbers you've given, even if it is high interest, it shouldn't be much more than a few hundred a month. Yes you'll give up a possible refund for a year or two, but that's better than losing your house.

 

Even so, I'd still consult with someone before entering an agreement, or just giving up.

Why would that make things worse? How could it even get worse? Several BGP members have been recommending that you consult with an attorney since January. Instead of seeking help/advice from semi-anonymous BGP'ers, contact a tax attorney that is capable of handling these types of issues and get the help you need.

One of the worst things to do when dealing with the IRS and/or any legal issue is to think you don't need professional advice /assistance. If it looks like you may lose your house, I don't even know how you think anything could get worse.

Will not lose his house. I can say that with 100% certainty unless the notices are just ignored entirely. If OIC did not work, payment plan certainly will. Interest rate will not be that terribly high and ask to have the penalties abated under reasonable cause argument of relying on a tax professional.

Murder could be a long jail sentence and they probably have lots more IRS agents where he is coming from.

Lot's of luck with dealing with those folks.

I can't even fathom this line of thinking unless there is a lot more you aren't telling us.
