How long would it be possible for the Republicans to kick the can down the road if they still had control of Congress?

I have never believed that criminals should play a part in the selection of judges, but I do not believe that there are enough Senate Republicans who possess a backbone to do the right thing if Hillary is elected.

So any judge nominated by Clinton is automatically unworthy to even be considered?

There is some talk that Garland might actually be approved during the lame-duck Congress session. The thinking is that whomever Hillary nominates will be far more liberal, and could pass muster if enough Senate seats flip, which also seems very possible.

Might be a case of "better the enemy you know".

Not necessarily. If she slips up and actually nominates a judge that believes that the Constitution means what it says, then of course Republicans should vote to confirm. I don't expect that to happen but I do expect enough liberal Republicans to break ranks and vote to confirm some extremely liberal activist judges to the Court.

 

Like Jim said, granting a hearing to Garland and confirming him may be the best that Republicans can hope for if Hillary wins the election. Future appointees are more likely to be Ruth Bader Ginsburg clones.

I think the GOP will regret not approving Mr. Garland.

Agreed, even if they dont confirm the nomination, at least they have done their job to hear the nomination. Doing nothing should equal immediate firing.

Great point. Everyone still has guns (heck everyone has more guns), the 2nd Amendment is still in place and abortion isn't changing regardless of court makeup. The biggest issue that has changed is the recognition of gay marriage. Nothing that fundamentally affects most folks day to day lives.
