The footage was posted to Facebook Monday by Nicole Williams, a ninth grade student at Scott High School who says school staff should have taken action sooner. "Schools, they go on and on about bullying and how bullying should be stopped, how we should feel safe at school. I feel like those students weren't really safe at all because she was getting beat up while other teachers were just watching her and not fixing it at all,” said Williams. A teacher did eventually break up the fight, according to school officials. A spokesperson for the Kenton County School district says they're aware of the video and the students involved are being punished. The school says they want to have a discussion about how these videos get online. "Children have mobile devices and are encouraged to use them for educational purposes. But unfortunately when there's an incident like this where things get posted to social media, we have to have a discussion about being positive digital citizens," said Kenton County School District spokeswoman Jess Dykes. No word yet on the students condition. Williams tells us she has been suspended and is up for expulsion. School officials would not confirm disciplinary action against anyone involved, citing student confidentiality.

School law and cell phone/social media is a tricky and crazy thing to navigate. Most schools phones are not allowed out but on lunch, any other time they are out, the teacher takes it.

I think teachers now allow cell phones in the classroom as long as it's being used for classroom activities - which I know seems hard to police.

Teachers do not make that decision, SBDM council does and almost all in our area do not want them out. No need for them out at all in a school setting.

March 23, 201610 yr Do students that are fighting in a public school have a reasonable expectation to privacy? I'd say no. It is not just those students fighting. It is anyone caught on that camera. If anyone is fighting, the one starting the fight might not, the one being attacked or not wanting to fight but does to defend themselves......absolutely.

I have a clear plastic shoe rack holder for students to put their phones as they enter. But without a 1-1 ratio of IPADS/Chromebooks in the school, the BYOD (Bring Your Own Device) policy is a huge help. However, students have to ask permission if they can do research, get on Quizlet to study, etc. Let's say a student is really struggling with a concept and it's taking him/her a long time to "get it". Let's say the teacher is working with that student and another student is filming this interaction without the teacher knowing---and then chooses to post it on social media. That would be extremely humiliating to the struggling student. Should the student that filmed the fight be expelled? No. But there has to be a solid policy and consequences for inappropriate use of devices---and the lines are very blurred.
