Ah, man, was hoping someone could interpret all that for us "non-lawyers"...but I did see in there a lot of "after enrollment in Grade 9" so seems it wouldn't apply...unless i overlooked something...

 

8th graders are subject to transfer rules if they play a varsity sport then transfer within the same school year!

Looking at this this link I say she is eligible IF the family moved into GRC's district PRIOR to her enrollment in the school.

 

The shocking thing to me and others is how fast this was apparently approved by the KHSAA and I will assume GRC was smart enough to know it's approved before playing her.

 

I didn't know , though, that you could request a waiver from the KHSAA BEFORE you moved. That's the only way I see the immediate playing at GRC having occurred.

That is the sixty-four dollar question. I can't imagine taking the chance on playing someone with even a question of eligibility issues.

 

I'm going to assume that this was on the up-and-up until I hear otherwise.

Clark thought it was OK because how many times has Goldie said that 8th graders are not subject to transfer rules which is totally wrong. Everyone in Clark Co. Must think this. How could Clark get approval when she attended Bath on Friday ond played for Clark on Friday and Saturday.

This was not for athletic reasons. Job and personal reasons and we will keep it that way. Bath Co will not be challenging this as Coach Graham and Coach Thomas are best of friends.

 

I hope we can wish this young lady the best and get back to the actual game.

if one or more of the following exceptions in Section 2 has been

Sec. 2) DISCRETIONARY EXCEPTIONS FOR WAIVER

a) BONA FIDE CHANGE IN RESIDENCE- The period of ineligibility

may be waived if there has been a bona fide change in residence

by the parents and student that precedes a student’s change of

schools.

For purposes of this bylaw, a bona fide change of residence

means the uninterrupted moving of the permanent residence

of the entire family unit of the student as composed when the

student was eligible at the sending school (including one or both

parents if at that residence) from one school district or defined

school attendance area into another school district or defined

school attendance area prior to a change in enrollment of the

student. To be considered bona fide, the change must remain

uninterrupted for the entire period during which the student

would have been ineligible if the exception was not applied. A

student who becomes emancipated does not have a bona fi de

change of residence by virtue of his or her emancipation and

change of residence for purposes of satisfying this exception.

Determinations of whether a student shall be granted a waiver

pursuant to this exception shall be based on the circumstances

existing as of the date of enrollment at the new school

 

 

Sec. 4) OTHER TRANSFERRING STUDENT RESTRICTIONS AND

PROCEDURES

a) The Commissioner’s office may appoint or hire a committee or

investigator to conduct any inquiry or investigation concerning

any issues arising under this bylaw or any other bylaw.

b) If any member school files a written objection to the factual

validity of the certification before the conclusion of the period

of time to which the period of ineligibility would normally apply,

along with the specific, detailed basis for the objection, then a

complete investigation shall be conducted by the KHSAA and a

ruling shall be issued through the Commissioner’s office.

c) A student enrolled in grades 4-12 who has participated in a first

team game shall not be eligible to represent a second member

school during that school year unless that student would qualify

for a waiver of the period of ineligibility in accordance with

provisions of Section 2 above.

d) A student is ineligible for athletics in this state if he or she

transfers from another state if the student was or would have

become ineligible in the state from which he or she transfers.

 

 

This can tell part of how it could play out, but I think there are still some interesting question brought up when does a application or move take effect?

 

Let's take this approach that if you think some action has to be taken, or needs to be taken. Prove it. Let's eliminate some of the speculation and get down to brass tacks to see if there is a real issue or just sniveling.

I don't think anyone is fooled here. Sometimes things are hard to prove and cannot be proved but still don't make them untrue. Like the Aaron Hernandez murder case. No weapon, no eyewitnesses, no nothing but circumstantial evidence, but he is stone cold guilty. There is enough circumstantial evidence on this thread alone, if true to convict. Just saying......

I went back because there were posts asking questions about it and hopefully it will answer the whole "8th grade" transfer question that has been burning.

 

I am like you Clyde, how quickly it could have possibly gone through, or if it was set out carefully ahead of time and the parties worked in conjunction/move of family/change of school to expedite an approval. (But this is speculation on my part).

And somewhere is this drama filled mess, no one has seen a copy of the video of the last second file from the Bracken County/Clark County game.

Send all of the refs to Fort Campbell for a week and whip 'em into shape for the season. Require that they can all run a mile in under 12 minutes, pass a vision test, and pass a reflex test that determines how good their decision making is in a split second. If people aren't for that, I'm not sure if they truly care about the well-being of Kentucky girls basketball!

 

Its a very interesting concept but once again, who pays for it? The individual ref's as part of their fees?
