New report says that the Assistant DA passed out a document to the grand jury detailing what is legal for an officer in regards to pursuing a fleeing suspect.

 

Problem is that it was ruled unconstitutional in 1985. It was a much lower standard than what the law is today.

It's interesting that you guys say she corrected her mistake. They took direct quotes where someone asked "Does Federal law override state law?" Instead of the simple answer "yes" she essentially said "don't worry about it."

 

You'll pardon me if I think you guys would have freaked out had it been the opposite way.

 

Muddying the waters certainly gives the impression that they were trying to lead the jury down one path.

 

They probably didn't need to do that. However, the fact that they did is telling.

Then you realize the significance of presenting the wrong standard of proof, especially when you present a heightened one to a grand jury. Sometimes a "whoops, I'm sorry" after you've handed out a sheet with a misstatement of law to the jury and presented testimony to them just doesn't cut it.

 

That's a really big deal when the sheet you've passed out has been ruled unconstitutional and hasn't been law during your entire career.

 

If you don't see how that's a big deal, then there's no point in us having this conversation.

 

 

If this were the guy who shot an officer in Pennsylvania was indicted and the same mistake were made, I would be up in arms about it, and I don't think I'm the only one on here who would either.
