Ha ha...it's always funny when a child is assaulted. Maybe you should get some speakers so you can hear her pleading to be left alone because her top was coming off. Please don't tell me you are putting blame on the child in this situation.

 

I dont think its funny when a kid is assaulted, I have kids.

Help me here, this was swim class correct? She knew she had to get into the pool right? In no way am I saying what the teacher did was right, just trying to figure out why she didnt want to get in the pool to start if it was a class requirement?

She had her hair done that morning for an event that evening and didn't want it to get messed up. Kind of a lame excuse, I'll admit but whatever her reason, the teacher should have just give her a failing grade for the day and moved on.

Imagine being a parent, walking into the pool area and seeing a teacher doing that to your daughter, what would you do?

 

I would especially like to hear what UKMustangFan would do if you walked in on this in progress and it was your daughter?

Another lame thing besides the teacher being an enormous idiot is whomever was taping the thing. Its supposed to be illegal to tape people without their permission.

For example, anyone is free to video a police officer on a traffic stop as long as they are not interfering?

 

And in cases like this I believe we should encourage students to video the event so it doesn't come down to he said she said.

You might be right, i'm not basing that on anything official. My question then is why do people have the blurry face thing done to them in many videos you see? I thought you had to give consent.

I don't understand a gym teacher ever trying to force a student to participate in whatever activity they are doing in class that particular day. If they refuse to take part without a physician's excuse, they get an F for that day.

I think it is equal rights, you have a right to video and the people in the video have a right not to be identified if they make their feelings known.

 

Perhaps one of our Legal Eagles can give us a more concise explanation.

So a student who is trying to run out of a building and escape the school, endagering him or her self should not be restrained and kept in the building? A student who is threatening to punch a teacher should not be restrained? :idunno:

There are states that it is illegal to video/record someone without their knowledge. That may be what he is thinking of.

Now that I disagree with, but only when absolutely necessary. A friend of mine is a middle school teacher here in Louisville and received special training on exactly what to do to pull two kids apart who are fighting. They have a pretty strict protocol around here for how to go about it.

Depends on the location. I dare say that if it is in public it is always legal but again we need someone smarter than me on this topic.
