No Charges for Tony Stewart in Fatal Crash

NASCAR driver Tony Stewart won't face charges for running over Kevin Ward Jr. - NY Daily News

NASCAR star Tony Stewart has reportedly escaped criminal charges for mowing down a rival driver on an upstate New York race track.

Despite having footage of the deadly moment, a grand jury decided there was not enough evidence to charge Stewart with a crime for killing Kevin Ward Jr., TMZ.com reported Wednesday.

There was no immediate confirmation of the report by Michael Tantillo, the District Attorney for Orange County, who was supposed to make his announcement at 3 p.m.

Mowing down? Maybe it's just me, but that's not exactly the terminology I'd expect to hear from a reporter (or at least an unbiased one).

That's the first thing I thought of too. And the second paragraph definately shows his bias.

Mart Smith Tweeted "DA: Kevin Ward was under the influence of marijuana." and "DA says toxicology evidence shows that marijuana in Kevin Ward's system was enough to impair judgment"

I think that should have been released earlier.

First I've heard of that.

Not surprised no charges were filed... Outside of Stewart admitting to either trying to scare him or trying to run him over, they didn't have much to go on.

Rule of thumb - if you are going to do something stupid to get yourself killed, don't do it impaired. This is going to hurt the civil case against Stewart also.

It's the NY Daily News... that's what they do.

That said, if you click the link now, it's been changed to "running down".

And, I see that "deadly moment" has been changed to "deadly accident". Oh, and the fact that Kevin Armstrong has been added in the by-line, instead of just Corky Siemasko.

The death of fellow driver which occurred when Tony Stewart's dirt track car struck him and killed him was found that the victim Ward had enough marijuana in his system to impair his judgement.

Pot kills folks and it has affected another person for the rest of his life.

Rightfully exonerated, especially in light of the pot in Ward's system. I had not heard about that.

I don't think Stewart should have been charged. I didn't know about the pot thiugh. What's that story?

I think came out in Tox reports from autopsy.

Fixed that for you!
