September 12, 201412 yr This was on KSR of all places. Police raided Cahoots in Louisville for a liquor license violation and searched EVERY patron before they were allowed to leave. I can't imagine that this will go well for them if the ACLU gets ahold of this--provided that they did follow through with their threat to search everyone. Police raid Louisville bar and search everyone | Kentucky Sports Radio
September 12, 201412 yr Paul F. Thompkins must not be in Louisville this week because no one there is having the Best Week Ever.
September 12, 201412 yr Not an expert by any means on this, but that seems illegal. Don't really know the details of this, but it sounds like if you throw out the whole Constitution thing and it's completely kosher. Matt Jones went to a pretty good law school, so I'm guessing he wouldn't let something like that fly on his blog unless someone was dead to rights. Officers can search for weapons to ensure their own safety, but absent reasonable suspicion past that, it's not really a good idea to go doing what it sounds like they did unless you like being sued and/or having a disciplinary record with your department (if you still have a department in a month). I know this is somewhat of a jump from a bar, but if you were watching an R-rated movie or similar adult themed event and one person was there raising hell, you'd be kind of mad if police came and arrested the culprit, then searched everyone else in the theater just to be sure. Police have a little bit (or a lot... according to the jurisdiction, judge, and jury) of leeway if it falls under the definition of 'suspicious places' (i.e., if you are standing outside of a crack house, then you can probably legally get patted down and you won't have much of a claim if you are trying to argue you were just an innocent passerby, and that's for officer safety). Maybe this was a suspicious place, but without knowing more, I doubt it makes KSR knowingly lets it get posted there unless it was something they had a pretty good guess as to the end result.
September 12, 201412 yr I'm waiting for some of our legal experts to comment. This doesn't seem right to me.
September 12, 201412 yr Trying to find the difference between this raid and a just say a raid at B-Dubs for the same infraction. Let me tell you, it wouldn't bode well for the Local Law Enforcement if I'm an innocent patron having lunch with my family and then be subject to a search for Law Enforcements own enjoyment and their so called own protection. Way out of line!!!
September 12, 201412 yr A liquor license violation and they have to search everyone? What for? I guess I'm going to jail because I would refuse to be searched.
September 12, 201412 yr I wouldn't think just being in a place of business that may be committing a crime automatically means you forfeit your right to illegal search and seizure.
September 12, 201412 yr Anybody remember about 5 years ago over in Cincinnati near the Queensgate area when Police raided a so called "Biker" bar and shots were exchanged in the Parking Lot? It wasn't really a Biker bar but it was frequented by the Biker's on a weekly basis. It was known for very good food and many people went there to eat. Innocent people! That same day a dad from Ft Thomas and his 2 boys ages 13 & 9 were detained and handcuffed face down at Gun point while everyone was questioned before being released. You kidding me???? Kids being handcuffed at Gunpoint for being in the wrong place at the wrong time basically. I get it that it was a tense situation especially with shots being exchange but at what point to the Police cross the line? The innocent people in Louisville that were subject to this will get their chance to speak on this....
September 12, 201412 yr Is this the Cahoots in the Highlands or the one out toward the South End? I'm not in a place where I can watch that video this morning.
September 12, 201412 yr A liquor license violation and they have to search everyone? What for? I guess I'm going to jail because I would refuse to be searched. I'm with you... If I haven't done anything wrong then I'm going to jail. The Police will then have bigger problems to address. It kind of reminds me of about 6-7 years ago while attending a High School Football game in Paintsville. The Local Sheriff wanted to give us a Breathalyzer test right on the sidelines right in front of the Highlands fans. When we suggested that they go ahead and take us to Jail without giving the test, the Sheriff's common sense kicked in and backed off really fast. He knew he was wrong whether we had been drinking or not.
September 12, 201412 yr Author Is this the Cahoots in the Highlands or the one out toward the South End? I'm not in a place where I can watch that video this morning. If I read correctly in the comments it is in the Highlands. The commenters said there was a lot of drugs used/sold there.
September 12, 201412 yr Were they checked to see if underage? Or for drugs? Nothing to hide then who cares. Isnt that what liberals say about the NSA snooping on us.
September 12, 201412 yr Author Were they checked to see if underage? Or for drugs? Nothing to hide then who cares. Isnt that what liberals say about the NSA snooping on us. Checking IDs to see if they are of age is fine. However, they were all frisked--that's not okay.
