Checking IDs to see if they are of age is fine. However' date=' they were all frisked--that's not okay.[/quote']

A frisk isn't a search. Which was it?

I wonder if past a history of problems with patrons at this particular business led the police to think that they needed to ensure no one had weapons.

Did they pat them down or did they empty pockets, etc.?

Huge difference in a search and a frisk.

According to Ybarra vs. Illinois the officers do not have probable cause to execute even a frisk of persons in the bar if they do not have "A reasonable belief that a person is armed and presently dangerous must form the predicate to a pat-down of the person for weapons."

So unless they thought that everyone in the bar was packing then they cannot frisk them. They were not the subject of the warrant.

Is this the Cahoots in the Highlands or the one out toward the South End? I'm not in a place where I can watch that video this morning.

If I read correctly in the comments it is in the Highlands. The commenters said there was a lot of drugs used/sold there.

Correct. It is the Cahoots on Bardstown Road in the Highlands. Funny little anecdote about that - one of my friends manages a restaurant right by there called the Dragon King's Daughter. About three weeks ago I met up with a couple of friends at DKD for dinner. I parked on Bardstown Road and walked right past the front window of Cahoots on my way to dinner, and at a glance, I saw what most definitely looked like an exchange of a little baggie and some money inside. When I got to the restaurant, I kind of jokingly said, "So I just saw a drug deal go down over in Cahoots." Everyone that was at the table already started to laugh, because apparently one of the folks in our crowd who had arrived about 15 minutes previously had seen the same thing happen earlier and said essentially the same thing when he arrived. Then our friend who manages the restaurant chipped in, saying, "Not the first time anyone has seen that sort of thing happen there, and there's no way it will be the last either."

The video is only 1:30 so not really sure which it is. The first person shown was just patted down fairly quick. No pockets turned out or anything.

Video is 1 minute 30 seconds long. The video shows a police officer standing in the middle of the pool hall with a flashlight pointed directly at the camera to obstruct the view. The man behind the camera says, "I'm allowed to record this," and the officer responds, saying, "Keep recording it...relax."

Then the officer, addressing all of the folks inside, says, "If you don't have anything on you, you've got nothing to worry about. We all straight? Alright, now, a show of hands: who's got something on them they shouldn't have? No one? We all...."

Then a female patron interrupts by saying, "Raise your hand, Brad." (Not sure who Brad is, exactly.) The comment is met with some quiet chuckles from the crowd.

The police officer looks around and then says, "Alright. We're gonna start over here in this corner and we're gonna work our way around. And if you go by and you're clean, you get to go out the front door."

Some of the crowd responds with some controlled indignation, and several make comments about the fact that they'll still have to pay their tabs at the bar. It then shows the officer begin to frisk patrons much to the other patrons amazement. The video cuts off not too long after they've frisked only the first couple of patrons.

(To clarify, per Rocket's question, they only show frisking in the video - no pockets or belongings are searched in the video.)

I'm in class and cat watch it, I was being sincere in my question

I know you are. I just don't have an answer with so short of a video.

I wonder of Brad actually had anything? and if he did is he still speaking to the woman that outed him?

Apparently not. There was only 1 citation issued: a 19 year old woman was cited for being underage but it appears she had an entertainment permit of some kind that allowed her to be there as a hula dancer. But I'd have to think he was still ticked off.

At least police weren't dressed in "Scary Looking" Military Style Clothing...athletic shoes, shorts and T-Shirts...that's not scary right?

Or do the one guys camo patterned cargo shorts look too militarized? I wonder if those are military issue camo cargo shorts, that would make them more dangerous, intimidating and scary...right?

What is shown in the video only shows frisks--but even those are not permissible unless they have a reasonable suspicion that the subject is dangerous and concealing a weapon. I seriously doubt that you can justify thinking all 40 patrons were concealing weapons.

Trampling on the 4th Amendment is the same if you're wearing riot gear, camo shorts or clown shoes.

I wonder if they actually frisked all of the patrons? Or just said they were going to to see if anyone reacted.
