Anyone? To me these are the pertinent questions. The "should he or shouldn't he" questions are a different argument and are not going to be part of the case.

 

Did CCH break the ADA law? Did they break the Rehabilitation Act? Were they negligent?

 

As far as ADA and the Rehabilitation Act contained within it, I don't see how Cov Cath could have done much of anything wrong. Their facility itself is ADA compliant, as far as its suitability for those with physical handicaps, and if you read the Rehabilitation Act's section 504, which I believe is the most pertinent portion of the act as it applies to schools and education, it says "no qualified individual with a disability in the United States shall be excluded from, denied the benefits of, or be subjected to discrimination under any program or activity that either receives Federal financial assistance or is conducted by any Executive agency or the United States Postal Service". Cov Cath is a private school. Public schools receive Federal financial assistance to provide those benefits, specifically.

 

I think the biggest argument in this case will end up being:

1) Whether Cov Cath afforded other sick students more assistance during their illnesses and treatments, therefore showing bias against Alex.

2) Whether Cov Cath gave their due diligence to putting a stop to the graffiti on the bathroom stalls and any harassment that took place.

All it will do is potentially put a little money in his pocket (money that he need only go to his retired NFL football player father or Hollywood makeup artist mother to obtain) and then make him look like an ungrateful jerk for spitting one of his biggest helping hands throughout this ordeal - the Cov Cath community.

I understand the frustration, but I think you're off base on this one. I don't necessarily agree with the lawsuit, but I think they handled it properly.

For those that know me this type of argument suits my contrarian side to a T.

 

I disagree with the "no win" situation. It put CCH in a "tough" situation but one that it should be able to handle. Jeni Dinkle's actions did not authorize her son to be a target and to be , allegedly, harassed . CCH cannot use the "well, her mom had sex with one of our students" defense.

 

Did they take action to stop the harassment?

 

Did they meet their requirements to provide Alex with an education?

 

Were they consistent in dealing with him and other students who were ill?

 

Did they intentionally make decisions with the hope of Alex transferring to make the problem go away?

 

I hope they are innocent of all charges.

1)Yes. Alex was involved in squirmishes between he and the "Victim" of his mothers actions. And lets not forget, the victim did not attend the school after Alex's junior year. Also, anyone who thinks that Alex was harassed by anyone else in the CCH community during this time has fallen of their rocker. In fact, I'd say Alex fit in great at CCH with a whole world of support. Also, I would like to know how much harassment Alex reported while he was still in school. Obviously the school couldn't detect a problem when if they didn't know it was there. I can tell you however, that the teachers and administration at Covington Catholic are not only top notch educators, but they are top notch human beings as well. If they knew of any situation going on, actions would have been taken.

2)Again yes. Alex would not have recieved a diploma if they hadn't. Covington Catholic is not the kind of school that would allow people to cut corners. I can assure you he would have completed the same work that every other student completed. Like I've said earlier, The teachers are top notch and would have done everything possible to help him out with his work.

3)As far as I know yes. Let's be honest here. If they weren't consistent, this would have come all the way through the administration and to ALL of the faculty and staff. IF this was the case, then that would mean that none of the probably 50 plus people stood up to say that their treatment of Alex is wrong. I cannot imagine a situation where all of the administrators and teachers got together and decided to be hard on Alex.

I'd agree with you there. You wait, try to let time pass to have a chance for a calmer mind to prevail. Then if you're still of the position that a lawsuit is required, build together what you can to present a case, and present it. It takes time.

I strongly agree with the bolded part. I do feel the school did all they could and went above and beyond IMHO on the handling of Alex's situation. I am not sure about the writing on the stall, though but if Alex or the family did not report bullying - you can not stop it. I actually think there is always some level of bullying/hazing/harrassment that can never be stopped entirely. Boys kid and joke with their friends even all the time, sometime it gets carried away. Not saying that happened in any of this, just that it happens.

I don't know how long the statute is for a claim such as this, but it's very possible that it's a 1 year SOL, meaning the suit had to be brought now or Alex's claims would have been forever barred.

The claims in the lawsuit differ from your opinion. They have many claims that CCH knew but did not respond appropriately. You are correct, though, that essentially only one student was named as the aggressor.

Its not a matter of cutting corners in their lawsuit. Its more of a case of being responsive and living up to what they said they would do.

1) How do we know that the graffiti was not a solicitation from a convicted sexual predator?

 

2) Mr. Clyde, I understand your differentiation between the CovCath community and the family's feelings towards the administration, but were I able to ask the questions in court I would ask the family if the community support was worth the claimed anguish this kid claims he endured.

 

3) It should also be noted that while this was going on, CovCath and the Diocese was being sued by the victim's family. I would think they were very conscience the actions of the people in this case.

 

4) While intellectually I do agree with some of the arguments for exercising restraint, this is the internet. I am mad as hell over this because I feel duped by these people. I read all the updates that came from the school. I read those notes written by the Predator where she did speak of how supportive the school was of her son. It is sinful that these slime balls, and I’m not talking about the attorneys, may get a single dime for this.

 

5) Alex no longer has my support. I prayed for his recovery, but he’s shown he now has an attorney and no longer needs my support.

 

6) I no longer feel sorry for Tom Dinkle. If this is about money, sell the house. It doesn’t matter when you bought it. Man up and give your son some fatherly advice.

 

7) Not surprisingly I have no sympathy for the Predator. She knew what she did was wrong; after all she had to sneak the victim out of the parking lot in the back seat of her car. The idea that she even WANTED to attend graduation shows what a warped narcissist she is. If the sexes of the people in this case were reversed, she’d be in jail where she belongs.

 

Finally, all of this shows just how up-side down our society has become. These people should go away.
