February 25, 201511 yr Eric Deters says he should be a lawyer again COVINGTON – Controversial former attorney Eric Deters wants to be a lawyer again. He filed a federal lawsuit against the Kentucky Bar Association, alleging it didn't have the legal authority to suspend him. The suit comes after Deters resigned from practicing law as he was facing a possible disbarment. "Deters is no saint," he says in his complaint, acting as his own lawyer. "He is a sinner. But Deters is fit to practice law. Lawyers are not a chorus of angels." He has asked that Kentucky Supreme Court rules be declared unconstitutional so that he can return to practicing law. But the Kentucky Bar Association wants Deters' complaint dismissed. It says in its own response in court that Deters' challenges to Kentucky Supreme Court rules are, in fact, constitutional. John D. Meyers, executive director of the Kentucky Bar Association, would not comment based on the pending litigation. Deters could not be immediately reached for comment. In his complaint, Deters argues that he retired from practicing law last year, but the Kentucky Bar Association refuses to acknowledge that. He says that means he has been effectively serving more than a year under suspension – more than 400 days – and he should be reinstated. "Being suspended is the same as being branded with a Scarlet S," Deters said in his complaint. Deters was suspended twice from practicing law in Kentucky and notes in his 63-page complaint that he served a 61-day, a 60-day and a 30-day suspension. The latest in Kentucky, a suspension in the fall of 2013, involved false statements made in a libel suit brought against Kenton County Commonwealth's Attorney Rob Sanders and a separate civil suit filed in Campbell County involving a homebuilder. Because of an agreement between the Ohio and Kentucky supreme courts, in January 2014 Deters received a 60-day suspension from practicing in Ohio for the same actions. Then, in April last year, Deters told The Enquirer he would quit practicing law in Kentucky, and withdrew his application for reinstatement from the court. He said he planned to continue with his Ohio practice. But that couldn't happen. The Ohio Supreme Court ruled that Deters' license could not be reinstated in Ohio until it was reinstated in Kentucky. So rather than reinstating in Kentucky, Deters decided to retire in Ohio. "I am retiring from Ohio and I have sent in my papers," Deters said then. And he added that he wasn't going to try to practice in Kentucky again: "The reason why I'm doing it is because I don't want to practice law in Kentucky anymore," Deters said. "I have no desire to even attempt to get reinstated in Kentucky." Deters also had served a suspension in Kentucky in 2012 for knowingly making a false statement concerning the qualifications or integrity of a judge, breaking solicitation rules in a case involving a teen injured in a bus crash and failing to return a $1,500 fee to a client. Acting as his own lawyer in the federal complaint, Deters asked the court for a temporary restraining order that would block Kentucky Bar Association from suspending him past the order of the Kentucky Supreme Court. That would mean Deters could practice until there's a ruling on the constitutional questions of the Kentucky Supreme Court rules. He said he's been "affected in a personal and individual way," adding that "the pain is ongoing." He listed stress, weight gain, an immune-system drop that led to an infection causing him to nearly lose an arm, embarrassment, office stress and mood swings among numerous ways he's suffered. "What Deters incurred, lesser men would have crumbled long ago," his complaint stated.

February 25, 201511 yr Quite frankly the term "again" should be stricken as I don't believe he was ever a real Lawyer to begin with. Given his repeated unprofessionalism, he is an abomination to the bar and the entire court knows it.

Uhh, OK, we'll just say that the suspension is the cause of the embarrassment. :lol:
February 26, 201511 yr He was/is a loud mouth that everyone loved talking about. He was like a soap opera. His PA announcing at was second to none. Like 75center said, give us something else to talk about. Wonder why we haven't heard from the other local celeb......errrr person in Independence. Coincidence? Maybe!
