Great question, I would think they would have a case for liability similar to corporations who pollute the environment.

This is what I'm thinking. I might drop it down to 50 or so, as I believe ads in magazines were still allowed through a portion of the 70's.

I always got a kick out of one of Denis Leary's rants on the subject.

Curious to know if there is a difference in the kinds of lung cancers that you can get. Is there a certain type of lung cancer that is definitely caused by inhaling tobacco smoke? If so, then I think someone who inhales second hand smoke and gets lung cancer has a case.

I'll be honest. I was talking about my mom who passed away last year at the age of 79. Never smoked a day in her life but developed lung cancer. Her doctor told her basically that he only sees her type of cancer in patients who smoke and that hers, in all likelihood came from being around secondhand smoke.

Nothing illustrates the decline of this country better than the stupidity of so many juries. The odds of seating a jury that would vote in favor of penalizing any company responsible for a death to the tune of billions of dollars should be extremely slim but assembling a jury of idiots has become way to easy for ambulance chasing, slip and fall lawyers in this country. The lawyers who bring this type of lawsuit should be disbarred and judges who allow these outrageous cases to go to trial should be impeached, IMO.

Products liability MAYBE...Battery against a loved one who smoked in their house while they were growing up...are you going to sue your parents?

No, pollution from industries affects air quality that we all live in. You can not avoid it. Smoking is done by one person in his home, or in a business. You can avoid it as an adult, as you chose to live w/ a smoker.

I agree with this. You could almost say that those who smoked and honestly didn't know about the risks are probably already dead. If they missed out on the first round of settlements back a decade or so their survivors may be able to sue but my guess is there is a statute of limitations.
