Why this man was asked to take his U.S. Flag down!

Nothing about this story makes any sense, that's what the problem is. We get bits and pieces of a narrative that make the apartment manager look like a doofus and a couple scary phrases with no backup other than this guy's story about creeping Islam or something.

If they told him to take it down, they'd better have a darn good reason. The story doesn't make me think that they do. But the story doesn't make me think much of anything at all apart from "Where's the rest of it?"

If there is a regulation that you are not to fly any flag, then you signed the lease and have to live by it.

If there is not a regulation and a Muslim(s) complained, maybe they should consider all the protections our Constitution affords them and reconsider their complaints. If they are offended and dislike our flag and what it stands for, maybe they should think about moving to an Islamic nation, native born or immigrant. As, I for one, stand for our flag and our Constitution.

Agree that the "threat towards the Muslim community" quote makes zero sense. I'm leaning towards this being all on the manager and not a result of complaints or a corporate policy.

I know you are sharp enough to get my point... Most liberals do. They just will not admit it. And if you moved to another country, I bet you would not trash their flag and way of life so why do you defend their actions...

Do you consider me a liberal? Your post appears that way.

Whose actions did I defend?

What I know is that a generalization was made...and I am not usually a fan of that. Let's talk facts, not what we assume to be true.

But we do know they are complaining about our Flag which is supposed to be their flag since they come here.

I didn't read in the article where anyone besides the complex manager was complaining about the flag, so no, I do not know that "they" are complaining.

Statistically 70% of immigrants, both legal and illegal are on a government support system of some sort... so if you got 10 folks complaining, 7 of them are receiving benefits.

Ah yes, that old broad brush.

Good thing Death Row isn't populated with 70% guilty and 30% not.

Funny how they hate our flag, but love our welfare system...

And down the tube this thread goes...

H.R. 42(109) Freedom to Display the American Flag Act of 2005 - States that a condominium association, cooperative association, or residential real estate management association MAY NOT adopt or enforce any policy, or enter into any agreement, that would restrict or prevent an association member from displaying the U.S. flag on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use. So YES, he has the right to display his flag...

The lessee of an apartment does not have an ownership interest in the apartment complex.

That law applies to things like condo associations, homeowners associations and the like.

The apartment owner can pass whatever restrictions it likes on the property it owns provided those restrictions are within the bounds of state law.

A signed lease gives you a right to exclusive possession or use.....

A signed lease gives you a right to exclusive possession or use.....

Wasn't exactly my point.

The act specifically mentions being applicable to three types of entities: "condominium association, cooperative association, or residential real estate management association". An apartment complex has as its owner a private individual or corporation. All three of the mentioned entities are organizations comprised of the owners of individual properties to which they have their own ownership interest. That's not the case in an apartment building.

I think the apartment building is well within its right to make rules about the manner in which flags are displayed. Now... the prudence of exercising that right is another matter.

Huh? Condo's don't have a lease, you own it generally. You just have to follow the rules of the condo association.

We're getting a little bogged down in trying to parse through this particular law here but the way I'm reading it, the law is designed to prevent associations from creating burdensome restrictions on flag display that are binding on private property owners. It is not applicable to renters living on the private property of someone else.

That's the strategy...bog conversations down in details that are out of context to avoid the legitimate discussion of the whole circumstance. Not just on BGP. Not just Left or Right. It's our MO these days and one reason for the ever widening chasm of dissent.
