The last time I upgraded my phone they grandfathered my unlimited data plan onto my new phone. When I added a new phone onto my account for my daughter that phone was under a new contract but my wife and son's phones as well as mine all had unlimited data grandfathered in.

As some one who works in the cell phone business, I can tell you the only way to keep your unlimited data is to buy the phone outright or buy it off of say craigslist. I can also tell you, that eventually the carrier you are probably on will eventually just weed out all the unlimited data plans and switch you to a different plan.

I upgraded to the 4S last year and kept my unlimited data. Now it may be a Best Buy thing but they should be able to keep you with your unlimited plan.

My most recent upgrade last October the unlimited was grandfathered in. We had the option to keep unlimited or go to the new plan.
