This is a crime of ignorance but it isn't a hate crime and a good lawyer could keep it from being charged as a hate crime as well. Saying you're not going to make it out of the neighborhood doesn't qualify a crime as being hate and neither does the fact that it is a black guy who beat up a white guy. The story reads that the black guy was making fun of the white guy and then said you aren't going to make it out of the neighborhood. That's not enough to prove a hate crime took place and the police said as much.
