Hospital granted dad's request: no black nurses, lawsuit says

Featured Replies

I went to a Hooters several years ago and was seated at a table staffed by a male person. I very politely pointed out that I didn't come for the outstanding cuisine and asked to be seated at another table. What's different? I don't agree with him BUT it's his prerogative to have who he wants working on him or his child. I don't see how the nurse was harmed so I don't think she deserves a dime. Think she has an attorney working on contingency?

I'm thinking Hooters judged you!

The nurse still got paid, right? While an ignorant and absurd request, you get nothing...except maybe fired if you cost the hospital hundreds of thousands in attorney fees.

Do you have to be monetarily damaged to be racially distriminated against?

Good legal question. It's why I asked what I did. Was she harmed?

He is dumb for the request, but he is paying the bill, Hopefully, but I am going to assume I am since he is ignorant and probably on medical card. So he has no right, but he got his way.

The nurse is dumb for fighting it, why does she have to act like that, can she just not go on about her job with other babies. Is it that big of a deal to her. One less baby to have to care for because of an idiot.

Hospital should have said to him, sorry we dont discriminate, if you feel this way you need to find another hospital.

I also dont see it any different than a religious request.

If she loses the case will she be able to sue then for wrongful termination when they can her?

A question. If a woman goes to a hospital is she within her rights to request only female nurses?

The racist is ignorant and the nurse is also. Does she have to blow it up to this. If I am a white nurse adn some black guy ask for only black nurses, tehn fine, I comply and think how dumb he is while I go on about my business and JOB.

Clearly, this is wrong, and the man is an idiot. I work in a very racially integrated hospital. I can look at this in a couple of ways.

I am white and work in the department of psychiatry. Occasionally there are black patients who do not trust/like white people and respond better to our African American staff members. I have no problem with this as we try to do what is in the best interests of the patient. When the situation is reversed, my black co workers don't have a problem either. However, we would never post a sign to that effect. The charge nurse tries make assignments keeping in mind all of the patients' needs and matching them up with nurses most appropriate to meet those needs.

Secondly, the hospital did seem to cave into this man, however, it could be also viewed that they tried to protect this nurse. Nothing this woman could ever do for his child would be right in his eyes, and God forbid something happened, she would be to blame. Also, a racist like that may physically put her in danger.

Bottom line is, you are not going to change this man's bigoted ways. What is in the best interest of this child? Personally, I would think it would be to be cared for by a nurse with 25 years experience, but he was obviously too ignorant to see this.

What if the husband does not want any male nurses in the delivery room with his wife and only wants female staff due to some religious belief? Somewhat the same thing?

As long as the nurse did not lose any pay and still had her shifts, and if the hospital let the crazy swastika dude know that there were no gurantees that they could honor the request, the situation can be managed.

You beat me to it while I was posting.

With all that in mind do you believe (your opinion, not as a matter of law) the nurse deserves a payout from the hospital?

Let me make one thing clear first. If this had happened at my hospital, our administrators would have politely told the dad that he was welcome to safely arrange transport for his child to the closest all white hospital that provides the same level of care. ( which of course is impossible) That is what this hospital should have done IMO.

That being said, I do not think she is entitled to any financial compensation. She was not denied employment, just the victim of poor judgement on the part of her manager. It is a great opportunity for the hospital to learn.

When our administrators or staff screw up, there is always a "corrective action" required. . I think it would be appropriate for a well integrated panel of employees and administrators to get together and set a policy to determine why this happened and how it should be handled in the future. I also see no problem with reprimanding the administrator who handled it badly in the first place.

But financial compensation? No.

Are Feminazis a protected class?

Having a double standard is All American, correct?

Not sure. Could they have language in their contracts that states if anyone brings charges up against their employer they can be terminated? Or, maybe if they bring charges and lose? Not my thing but they will, at the very least, make things like promotions really difficult for her.

Good question. We also experience this and I have had this discussion with my male counterparts. Most are willing to work around that issue. OB/GYN is a whole different ball game though, because there is no getting around the very personal nature of the job. Not sure how I feel about it. I would be willing to bet most male nurses choose different fields of nursing because of it though.

I would be willing to bet that most women wouldn't care at all by the time they hit the maternity ward.
