It does say they can enter the room as administrators--but not as police. The officers even made that clear when they were talking to him at the beginning. They said that as administrators, not police they could enter his room. They did mess up when he pushed the student. However, he was also in trouble for searching inside the fridge. The administrators can go in and perform a cursory inspection of the room but they cannot search through anything not in plain sight. In order to search the fridge, dressers, under the mattress etc. they would have to enter the room as police officers with either permission or a warrant.

Further proves the point this Officer should not have been fired.

Losers and derelicts have the same rights as honor students and medal of honor winners. It is a shame that the officer let a punk get the best of him but that is on him. Let me ask you this: Do you think the officer puts hands on the kid and opens his fridge if he would have known he was on camera?

Agree! I just hate the fact that this POC is going to get away with setting this cop up. He obvious has an agenda against Law enforcement. If it wasn't this Cop, it would have been the next. It's a real shame this happened. Hopefully, what goes around comes around for young Graham Gaddis.

I'm guessing Graham Gaddis has retained Counsel. His social networking accounts have been closed and he took off the video. He's up to something. Well, that is obvious from the very get go.

It looked like he pushed him after he was already in the room. Due to the excessive provocation by the student I don't feel like the officer should have been fired but he should definitely been at least suspended. As an officer he has to have a thick enough skin to not violate people's rights just because he is angry. This time it was an unlawful search. What if he hadn't been fired and he got called back there? Is it a stretch to think that he might have roughed up the student and arrested him on a bogus charge if there were no witnesses? I know I would want to and he had already shown he was willing to disregard the law because the kid was a jerk. He knew he was in the wrong--you could tell that by his reaction once he realized he had been recorded.

 

I completely agree with you on the disorderly conduct charge. I'm not sure why they didn't nab him there unless they needed a complaint to do so. Hopefully if there is such a thing as karma Mr. Gaddis will really need an officer's assistance at some point in the future and there won't be one available...

He can cry about it being on YouTube all he wants, it's going to keep going up. He's flunking out school and is an utter slime ball. This was an orchestrated plan and now like any other lazy loser, he plans to make a "living" by filing pathetic lawsuits.

I find it interesting that so many people say that the cop was set up.

Police are specifically trained to handle situations With unruly people, drug addicts, thieves, criminals, drunks, etc. It's apparent this police officer did a poor job of it, and he was fired as a result. Call me crazy, but I have no sympathy for an overzealous police officer.

Go figure...but his actions meet the requirements of DC 2nd if there were other students in the hall and anyone who's lived in a dorm, knows other kids were out there watching.

 

I don't know how you can say he didn't plan this. His actions prior to running his mouth and after the officer left show this was what he wanted.

Just watched the video for the first time and I have to admit, the kid is a complete punk. He initiated a lot of it with his initial comments & antagonize the police officer, but still think it's the police officers duty to exercise restraint.

 

With that said if I'm an officer involved in that type situation, you better believe that I'm looking for any way possible to charge this kid.

 

I did get a huge kick out of the kid's "oh I'm 2 Cigarettes deep, I'm belligerent" comment.
