The colonies and future territories ties freely joined in a union and the Constitution says nothing about being bonded together forever. Since nothing is said about it, the 10th Amendment would come into play. All matters not mentioned in some way in the Constitution are left up to the states. Therefore, I believe the states have legal standing to leave if they wish.

The only recourse that Lincoln had to force the states to remain in the union that had seceded was to fight a war.

A war that he won. Not all issues are settled on paper. That one was settled on the battlefield. The states would not be allowed to leave.

 

The legal question was not settled. There is nothing in the Constitution about having to stay. Big government types ignore the Constitution anyway. But then most secessionist movements are settled by force.

These petitions are hopefully to show that there many who do not want big government and that Republicans should stand firm with small government supporters.

The Republican Party has to fight very hard to keep the people supporting this type of talk from gaining any leverage in the party. Amazingly, following the election I have seen and heard numerous Republicans talk about how the party is losing ground because they are moving away from their conservative philosophy. The Republican Party needs to get their act together. If stuff like this keeps up, they may have to change their symbol from the elephant to Chicken Little.

Just read on TheBlaze.com that Justice Scalia replied to the secession question once and he stated that states did not have the right to withdraw from the Union.

He said that if a state sued to secede it would need the permission of the Federal Government to be sued and he assumed they would not give permission. But, to me that does not mean the state cannot secede, the feds are just refusing to be sued or accept the fact a state wishes to sever its bonds with the Union.

But then Scalia is sitting on the bench in DC and I am sitting in my easy chair in Pendleton Co.
