From a legal standpoint the fact that Zimmerman didn't stay in his car is irrelevant.

"There is no indication that Trayvon Martin was involved in any criminal activity at the time of the encounter."

 

While this was initially filed to seek a negligent manslaughter charge and was denied Zimmerman getting out of the car and causing the encounter is the basis of the prosecution's case.

Would he have to attack him? Let me put it to you this way. If you were walking in a relative's neighborhood doing nothing wrong and someone began following you closely while talking on the phone would you wonder what was going on? Then if you tried to get out of there and saw them get out of the car and pursue you what would you do? If you were armed would you draw your weapon? Even if you weren't armed would you become aggressive towards them or wait on them to make a threatening move?

A lot of unknowns in this case. Even if he stopped pursuing him when told by the dispatcher it might not have mattered. According to Zimmerman Martin ran and he got out of the car and chased after him--for how long we don't know. We can be fairly certain that if he didn't get out and begin that chase that the ensuing confrontation doesn't occur. After all, once he was in fear for his life Martin had just as much right to stand his ground as Zimmerman did--he just didn't have a gun.

He said he then walked to look at a street sign when Martin asked him "what's your problem?" He said he looked down to get his cell phone and when he looked up Martin punched him and knocked him down.

I didn't see anything in there that says getting out of your car after the dispatcher said to stay in the car is anyway a basis for anything involving the dispute of SYG.

What they believe and what they can prove are two different things. From what I've seen and read they can't prove he didn't stop following Martin. The only version we have is Zimmerman's and so far the evidence supports his version.

Exactly what I've been trying to say.

I know since there is no trial its interesting to have one outside the courtroom. But the issue with this 'new photo' is that the grainy, black and white version that was far less graphic was WITHHELD by the police and the prosecutor from the defense for months. I would still not hazard a guess as to guilt or innocence but the recklessness of the prosecutor of withholding the color version of this photo, coupled with the NBC slice and dice of the 911 call make this whole process and the reporting of it a circus and does little for anyone's faith in 'the system'.
