No. But it has been proven to be harmful, right? A person charged with DUI hasn't harmed anyone either. The risk is there, so whats the difference? Also don't forget PI laws. The only place it is not illegal to be drunk is in your home. Correct?

But I feel like it's an activity (like many others) that can be enjoyed in a manner that doesn't adversely effect others. I mean, I like to play the guitar, but I respect others enough to not do so in public because I know innocent people would be harmed. It's like that with smoking I think.

It has been proven to be harmful to people who live with smokers. It hasn't been proven that someone who visited restaurant with a smoking area was harmed.

January 14, 200818 yr As bad as the air quality is in our area, what with the chemicals from plants and the diesel fumes and coal dust from railroads, you would believe that the filters on cigarettes are prolonging lives!
