I have a question....After I get a couple answers, I'll let you know why I wanted to know. What is standard procedure (if there is one) on how officers handle an individual who they've pulled over for a traffic stop that has their concealed carry permit and a weapon on their person?

Check their permit to carry a gun, have the weapon checked to see if it has been stolen & send them on their way.

Whenever someone is pulled over who has a CCW, it immediately shows up when they run their plates. So the cop usually knows going into it theres a chance he might be armed. Then it all depends on the cop. Sometimes they will ask where it is or want to see it. They have the right to take it for the duration of the stop, for their own safety. Most cops won't care, but just want to know where it is for their safety.

This is what I do when I am pulled over (it's happened twice).

 

I give him BOTH my driver's license and my CCDW. I IMMEDIATELY state that I will keep my hands on the wheel, and follow whatever directions he gives me.

 

They usually ask me if I am armed, and if yes, then where is it? Both times it was on my person.

 

One time the officer asked if I would place it in the glove box while he stepped behind my vehicle.

 

The other time he said "fine", and proceeded with whatever had caused him to pull me over.

I have been asked to step out of the car. I did not mind. I wouldn't be comfortable having someone reach into the glove box to hand me their gun, either.

How does a person go about getting a concealed weapons permit? I have been thinking about getting mine. Any help would be great!!!

If I were the cop I'd ask you to step out of the car and then I'd say "Let me see ya dance...." then I'd start firing rounds at your feet

Ok...Here's the reason I asked. My room mate was pulled over yesterday for violation of the noise ordinance. When the officer came to the car, he handed him his Driver's Liscense AND his CCDW. The officer asked if he had a weapon, and he said yes, that it was on his right hip. The officer asked him to get out of the car and proceeded to pull his gun on my room mate. Asked him to put his hands on his head and then the cop came over and took the gun off my room mate. He did give it back to him at the end of the stop.

 

The reason I asked was because I find it hard to believe that an officer pulling his gun is procedure in a situation like this, especially when the individual is cooperating 100%.

No clue as to what policy is but I have no problem with the officer's actions. If the weapon is on the hip, I'm guessing it would not take long to remove it and fire it, correct? Why take the chance? Take control. Handle the situation. Move on.

I agree with 81. The officer has to be in control and it doesn't sound like he did anything to violate your roommate's rights at all.

 

Once your roommate's gun was secured by the officer, did he holster his own weapon again and continue with the traffic stop?

I can't believe that's SOP.

I don't think he was offended, but definitley upset. He just thought it was a little excessive for a gun to be pulled on him when he was fully cooperating with the officer. I have to say I'd feel the same.

Another officer actually arrived, and once that officer arrived, the first one put his gun away. That was after he already had my room mates gun.

I see nothing wrong with the stop, he has the right to protect himself, due to the location of the weapon on your friend, he had cause to be cautious

No one else that described their experiences in this thread mentioned having the officer pull their weapon on them.

 

You also have to realize that I'd be a little nervous too, if this was LMPD we're talking about. Those guys have itchy trigger fingers.
