I've never stopped for a receipt check unless I have unbagged merchandise or if I went through the check out line with bagged merchandise that I paid for in another department. And I won't. If they want to try and stop me they better be well prepared to display that strong suspicion that I'm stealing or they can talk to my attorney. I also don't let let the police search my car. I have nothing to hide in either circumstance. I just value my civil liberties.

It's not violating your civil liberties, you didn't have to go to Walmart to begin with...at least I don't think shopping at Walmart is protected or demanded in the Bill of Rights :lol2:

Our local Walmart checks almost everyone all the time. Doesn't bother me, but I always tell my wife to just keep the receipt in her hand instead of putting in her purse until we get through the door. And she puts it in her purse, and we have to wait for her to dig it back out once we get to the door. That part annoys me. :lol2:

 

Sometimes I start to show it and they just wave me on through. It's not that big of a deal.

 

When I was fresh out of high school, I worked at the local KMart and my job was to stand at a podium, check all receipts, and keep a log of what made the alarm go off any time it went off. Couldn't leave that podium for anything. It was miserable.

Detaining me against my will is absolutely infringing on my civil liberties. And there is nothing posted that I agree to having my merchandise searched when I shop there. Therefore, unless I have an unbagged item or checked out in another department, I just say no thank you and continue walking when they ask to check my receipt and bags. They haven't tried to run me down yet.

I find it extremely annoying, especially when they’ve just watched me checkout. That being said, I worked in retail for over 15 years, some of that time in Loss Prevention. And I completely understand why they do it. Heck, we used to basically pat employees down (visually..empty your pockets, let me inspect your jacket or bags) every time they left the building. Don’t take it personally, and don’t make a bigger deal of it than it actually is. The simplest solution is to just not shop there rather than protesting, arguing etc.

I would probably have a different attitude about it but... I believe he is correct. If someone is "making" you stop/stay/be held there against your will - then that is unlawful detainment.... they can't "make" you stay. They also can not "make" you consent to a search of your property or person....

 

Their losses due to theft are not an excuse..... the fact that it is their store also does not matter either... you do not loose your right to privacy just by entering through the door or pulling into their parking lot.

 

The exception.. as has been said... are the private clubs that have memberships. to be a member, you agree to consent to those types of searches.... that's why they put that language in the membership contract... otherwise, they would not be able to do it. if you do not like, then do not become a member.

By the way... i have always and always would consent to show my receipt regardless of the situation.... it seems the courteous thing to do.

I think it is actually. it is small... it is quick... it is silly to not just show the receipt... but technically... making you "stop" and show your receipt is keeping you there when you would otherwise continue moving.

 

The reason they don't run you down - other than the greeter being too old, under qualified and it being extremely dangerous to do such a silly thing - is because they can't legally "make" you stay any longer than you want.

 

if he wants to keep walking - they can't stop him.... now why anyone would just not show the receipt based out of principle... i don't know... seems petty.

They ask for a receipt, you either show it or you don't. If you choose to stop they aren't detaining you.

 

If you have actually stolen, then they can make you stay longer than you want...but that's different than asking to check a receipt. How each company handles that and what each needs as eveidence to detain someone differs from company to company.

Little known fact: You DO NOT have to exit from a store before the store or LE can charge you with theft/shoplifting. If you conceal merchandise on your person you CAN be immediately charged with theft...most companies will not stop you at that point but they can and LE can as well.

I hear ya... to each their own.. but sometimes its just easier to deescalate a situation rather than to stand your ground on principle.

 

Have you ever seen the Youtube video of the guy that open carried an assault rifle to the police station because he was upset with how he was treated during a traffic stop? it was his civil liberty to open carry, but wow, that was a squirrely move on his part.

You know how much I drive with my job, right? It's happened twice. Both on the interstate. I guess they're looking for drug mules. Neither officer wanted to bother with a canine unit and let me go on.
