Did a quick search and found that the SCOTUS limits the Roe v Wade issue to abortions and not to how a state defines a human, thus, fetal homicide laws have been rules legal.
April 5, 201610 yr 74 posts and the subject is null and void because abortion will never again be illegal in the United States. Life begins at conception, Period. The heart has started beating at 18 days and brain development at 25 days. Abortion stops a beating heart, this is not just a bumper sticker.These are numbers from medical journals.I am and always have been anti-abortion. The main dilemma is for those of you who could, would or have been party to abortions legally with Roe vs. Wade and illegal before. If there is such a thing as judgment day, and I believe there is, then it will be up to you. When judgment day occurs, there will be more than just those that have been party to abortions that will have some answering to do, so let he who has not sinned cast the first stone.

Correct, the question Roe answers is whether a woman's liberty interest in her own body outweighs the right to development of the fetus in her womb. Hence the Court decided upon the "viability" standard. My understanding of the law is the mother cannot be forced to essentially grow a child that could not survive on its own, but if that child could survive outside the womb, her rights take a backseat to the survival of the child (unless I assume her life is threatened). There are completely valid arguments for the legality of abortion on both sides of the issue, and as a man I am incredibly thankful I've never been in the position where a partner was forced to deal with this scenario. Regardless, when you consider the Supreme Court's position of answering the liberty issue from the mother's point of view, and state legislatures' positions of codifying criminal statutes pertaining to other parties, the inconsistency results, and while it is exists, it is at least explained. I'm unsure whether the Court has ever heard a constitutional case where a criminal defendant challenged a state conviction on 8th Amendment grounds (e.g. it is cruel and unusual punishment to be charged with murder when other areas of the law consider the fetus and less than a human life). Either way, I feel like the inconsistency is more of a talking point for the pro-life crowd. This is never going to be a "gotcha" moment which forces a law to be changed. In my opinion their best course of action would be to continue attempt to persuade the other side that a fetus is in fact a human life and hope medical advances continue to push viability as close to conception as possible in addition to continued development and access to various types of birth control.

I failed her greatly if my post sounded judgmental. My post was not meant to judge anyone other than myself, just myself. My post meant that when I stand before those golden gates I'm all on my own. April 5, 201610 yr So there should be no feelings of guilt about motherhood or an abandoned child. By the letter of the law if abortion is illlegal and you have an abortion you have broken the law and are now a criminal. People go to jail for a lot less. I don't want to hear the it's my body arguement. We lock up people for drugs, its their bodies, why not the same treatment. They are only hurting themselves yet are arrested and put in jail. Abortion you are actually hurting someone else. So no they won't get a pass for breaking the law and don't deserve one.

According to pro-choicers this should just be assault on the women correct? You can't murder a fetus, that couldn't possibly be.
