Georgia Woman on Death Row While Husband's Killer Will Have Shot at Parole?

 

In the request for reconsideration, Gissendaner's lawyers cite a statement from former Georgia Supreme Court Chief Justice Norman Fletcher, who argues that Gissendaner's death sentence is not proportionate to her role in the crime. Her lover, Gregory Owen, who did the killing, is serving a life prison sentence and will become eligible for parole in 2022.

 

Fletcher said he has now decided he was wrong in voting to deny Gissendaner's appeal in 2000 when he sat on the state Supreme Court, the statement says. He also notes that Georgia hasn't executed a person who didn't actually carry out a killing since the U.S. Supreme Court reinstated the death penalty in 1976.

 

I can't be the only one who finds this messed up, right?

 

How can you put her on death row, but the dude that actually did the killing can be out on parole in the not too distant future?

This is really messed up. UKMustangfan seems we may have finally found something we agree on. And it took someone to die. Might be a good lesson for all of us.

Isn't this the same thing that happened to Charles Manson? The only reason he is not on death row now is because California abolished the death penalty and commuted his sentence to life in prison.

This is WAY to difficult too pass judgement on without a very in depth knowledge of all the facts of the case.

Did the killer cut a deal and the woman go to trial?

I'm not sure how I feel about it.

 

Let me ask this question though. Do people think this guy would have killed her husband had she not been involved? Isn't she directly responsible for the killer committing the crime.

Where did I ever say differently?

I think he had a procedural issue in his case that allowed his sentence to be modified. Without knowing the details of what her involvement was, I wouldn't say it is unheard of to have the person who did the deed not get the death penalty.

 

I would be willing to bet she set her husband up and because of the planning, etc…was deemed "more guilty" of the premeditated portion.

I'm not a fan of death penalty at all. But I'm not against the person hiring the hit man getting the harsher penalty.

The SCOTUS has denied the stay.
