Question about legalizing marijuana. If I am serving a sentence in jail/prison because of marijuana can I get out of jail once it is legalized?

 

No, not currently. ResponsibleOhio is the group that is really pushing legalization in Ohio. If ResponsibleOhio's plan is adopted, Ohio would become the first state to jump straight to recreational marijuana (medical marijuana was legal in the other states that legalized all pot).

 

ResponsibleOhio's next step is something called the "Fresh Start Act", which is an inititive to do exactly what you said -- provide a path to expungement of marijuana convictions that would no longer be illegal.

Generally, I am in favor of legalizing marijuana; however, I have serious concerns over ResponsibleOhio's "business plan."

 

Basically the law, if passed, would allow pot to be grown on no more than 10 farms in the state. Coincidentally, most of the pot would be grown in Southwest Ohio (Hamilton, Clermont & Warren Counties). Those 10 farms have already been purchased (or are under contract to be bought) by the investors. They're in the process of creating an oligopoly that I am not okay with.

Less than thirty days until election day. I've seen a couple advertisements, but not as many as I expected.

 

Last week, the State issued a report estimating Ohio would earn somewhere between $133 million & $293 million in its first full year, if legalized.

 

That is significantly less than ResponsibleOhio's prediction of $533 million, but still a no brainer, in my opinion.

I'll admit. If Ohio legalized marijuana I would venture up north one time for a legal high.

Not sure about the 3 strikes. However every person I've seen from Ohio get in trouble over marijuana was shocked when they were headed to jail. FYI you don't have to go to jail for possessing marijuana in Kentucky. Depends on the amount, whether or not you're distributing, possession of drug paraphernalia etc.

Or, whatever police determine you're doing with it, regardless of actual intent.

That's usually determined by the court but yes you can still go to jail.
