Controversial Police Shooting at Wal-Mart In Ohio

Featured Replies

Manslaughter and involuntary manslaughter are usually reserved for when the direct actions of someone results in death. Example: car wrecks where someone was drunk, in some states and the other driver died, (and sadly I'm being serious... finding your spouse in bed with someone else), or depraved heart murders (ex. playing Russian roulette). Basically, they negate some of the intent mens rea from most other homicide charges.

I would argue that the callers direct actions resulted in the victims death.

Manslaughter is more a charge for direct actions as in you pulled the trigger, you drove the other car, you administered a fatal drug that led to an overdose, things like that. No chance manslaughter would stick. His attorneys would say that person didn't drop the weapon when directed or that the police officers didn't give a clear command to drop it and give him a chance to, and that's what caused his death.

This doesn't directly apply, but in tort law, there's a concept called the "last clear chance" wherein situations are evaluated based on who had the final chance to avoid things happening as they unfolded. That's probably a good way to think of it in terms of him being charged with manslaughter.

At least 3 Wal-Marts in the St Louis area have been shut down tonight as a result of protestors in the name of the victim of the shooting at the Ohio Wal-Mart store.

I do not think the police did anything wrong here. Someone with a gun in Wal-Mart they probably feared the worst like him shooting other civilians. Might have been a quick trigger, but you have to take into account the police didn't know it was a BB Gun and were trying to prevent other people from being injured. A couple things could easily have prevented this: The 911 caller not lying about what he had seen, and being smart enough to not walk through a store with a gun swinging around by your side.

Walking through Wal-Mart with a gun in the open is not illegal. I am the biggest supporter of Police ever, this one, they were wrong.
Already saw something on FB accusing the police of killing the girlfriend to cover up their interrogation of her.

 I figured that would happen

Walking through a crowded Wal-Mart carrying a gun and waving it around carelessly may not be totally illegal, it is reason for a police officer to believe you are at danger of harming other civilians. No one is going to carry around a gun in a public setting like that for no reason at all. It looks bad because it was a BB gun, but what if it wasn't? What if the police didn't shoot him and he ends up shooting a person in the store shopping. I just think that what they did was warranted, not happy to see that happen, but also don't think they are in the wrong either
