What do they have to lose? The Judge isn't going to increase the penalties.

 

A favorable verdict would be reduction of the postseason ban to one year, a reduction in the fine, an increase in games, or outright overturning the majority of the penalties.

 

We've seen this same song and dance before. KHSAA declares Cordia player ineligible. Appeal to KHSAA is denied. Cordia goes to Franklin Circuit. Cordia players are eligible.

 

Hudson's people being some of the key witnesses and Hazard getting no penalties isn't going to look good in Court when they try dropping the hammer on Cordia for buying him a plane ticket. If Cordia was buying him plane tickets but he left, what do you think someone might conclude he left for? Sounds like he had a pretty sweet deal where he was.

 

As LionPride has stated, the clothes were for a kid who was already at Cordia. It isn't wasn't some star athlete, but the KHSAA wanted everyone to hear the news when it broke and conclude that Cordia was decking their transfers out in new clothes.

 

Wanna make a bet with me that if a Judge takes the time to hear the case and doesn't immediately dismiss it, then that Judge won't agree wholesale with the KHSAA's findings? The KHSAA isn't going to go tell a Judge how high to jump and not to question their authority, but if they do, then that's probably even that much better for Cordia.

 

Everyone is still writing them off, but they've beaten the KHSAA in court twice already. Other schools don't even have to sue to get their transfers eligible. The courts have twice told the KHSAA to let Cordia's kids play. Now the KHSAA has stuck them with penalties, and they are back before the court. How do you think that's going to play with the courts? They've told the KHSAA to back off of them twice in consecutive years, and now they're back again with something else. I'm not the end-all, be-all on this stuff, but I have a feeling that this whole court thing just isn't going to play like lots of people responding are thinking it is.

 

If the KHSAA can't even convince their own Board of Control that 1/3 of the penalties they initially charged were there, why in the hell does anyone think that they're going to have the courts in complete agreement with them?

And that'd be stupid to do if you had a chance of getting out of those 2 years as well, risk free. A court says you aren't guilty of robbing 9 banks, then you aren't guilty. Easiest way to think of it: double jeopardy. You can appeal your sentence of 2 years for robbing the one bank, and they aren't going to increase the penalty.

That B.O.C. Is a complete joke it is a rubber stamp for the commishner and anybody that doesn't think so is out of touch with reality. They reinstated cordia because they were scared. I don't know for sure I think they will take it to court because several violations they found them guilty of they do not even have by laws against. That is why they will win in court.

 

No, the KHSAA piled enough on them, probably knowing, Cordia would go to court. Thus they could reduce it some yet still give them a substantial penalty.

I'll break it down in four sentences:

 

1. Judges don't like being told what to do in their court.

 

2. Judges say let Cordia's kids play-- twice in two years.

 

3. A Judge will be hearing another case about the KHSAA not letting even more of Cordia's kids play and gets to decide the outcome.

 

4. KHSAA might feel Judges are usurping them. Judges might feel KHSAA is usurping them.

 

Pretty simple. They've sided with Cordia twice, and the KHSAA is back before them again for the same type of issue. You think people feel like the KHSAA doesn't have any authority over the court system now, you might not have seen anything yet.

 

Considering all of that, do you see why I might say that I think it's just as, if not more, likely that the court really decides to send the KHSAA a message that they're tired of going through the same process of ruling against them every year instead of reversing course and ruling against Cordia?

I'll also add that the courts could come in and say all the penalties are too harsh, the fact that your argument in all of this is "everyone else does it too" is all I need to know about this case. Cordia was sloppy. Period. And now they have to pay the piper.
