May 28, 201412 yr I'm not saying what he said was right but what I don't like is that a private conversation was recorded and was trying to be used to blackmail him. I also don't like how the union in 2011 in the NBA accused David Stern of having a plantation mentality, nobody remembers those things. Racism can cut both ways.

I know I am late to the party on this point but is there a written, legal document giving her permission to record all of their private conversations or something lesser?

What is known or what has been reported and yet to be refuted is that he had her recording their conversations because of his fading memory. He also admitted it was his voice on the tape and that he said those things when he met with NBA Commissioner Adam Silver. If these were illegal recordings I don't know why he has yet to say they are illegal recordings considering everything else he has said. Seems like he could press charges or something. Why would he shut his mouth now?

Could be wrong on it (and different States have different rules of evidence), but I'd think that the suit between the NBA and the Sterlings would be a separate issue given how the evidence in question has got out and has been so publicized. There'd definitely be a suit on behalf of Sterling against his girlfriend for the illegal wiretap (California law requires two party consent) but I'm not really sure that the conversation, even though it was illegally recorded, would be something that would be excluded in the NBA suit.
May 28, 201412 yr Isn't the point of how the recording came to be a moot point. He's not being tried for a crime. The NBA isn't taking him to court for anything. The only thing that should matter to a court at this point is the NBA ownership agreement he signed when he bought the team and any codes of conduct that they have instituted since then.

Going to cost him more to sue her than he could win. I don't know if criminal charges could even be brought in this case...I think he would have to go the civil route and there just isn't much to get there.
