November 10, 201114 yr That's why Joe Pa was fired, and Joe Pa didn't even see it. It's not right to fire Joe Pa and not fire him. Joe Pa had hearsay, he had eyewitness testimony.Bingo. I'd also add, "for not being a decent human being"...
November 10, 201114 yr ^Lucky for me there is no business law on the cpa exam.... He followed their policy, but that doesn't mean he can't be fired. He brought shame to the university, that's grounds enough for firing.
November 10, 201114 yr Honestly, how does McQuery witness this and continue on as if nothing had happened? Unfathomable. Seems like something is missing here.
November 10, 201114 yr I'd say McQuery should resign, but I don't think it would be too easy for him to find a job elsewhere.
November 10, 201114 yr Author Honestly, how does McQuery witness this and continue on as if nothing had happened? Unfathomable. Seems like something is missing here. My wile theory, McQuery was offered a job on the staff permanently from GA spot to keep his mouth shut. At this point nothing would surprise me, so why not.
November 10, 201114 yr What if your policy states to follow procedures and he did? I can see him being charged by the police for not reporting a crime. I'm talking about the institution he works for. Why have policies otherwise? Maybe our approach is the wrong one. Maybe what we should be advocating is for the assistant coach to resign himself. I still have a problem with the procedures part. At what point do the Paterno's and the Grad Assistants stop following up themselves and learn to live with what they know/saw?
November 10, 201114 yr I'd say McQuery should resign, but I don't think it would be too easy for him to find a job elsewhere. It would be easier if he resigned than if he stays on and the mess gets worse and deeper.

At this point nothing would surprise me, so why not.Didn't think of that. At this point, it fits. If that is the case, could he face charges over that? Or does reporting to Paterno keep him in the clear?
November 10, 201114 yr Author Didn't think of that. At this point, it fits. If that is the case, could he face charges over that? Or does reporting to Paterno keep him in the clear? I don't know enough on their reporting laws to even speculate on that. The only things any of them could really face are 1. Perjury 2. Obstruction of Justice and 3. Failure to report. 1 and 2 will be extremely hard to prove and 3 he has to fall in to what the Pennsylvania statute requires to be guilty.
November 10, 201114 yr The entire situation is messed up. I think McQuery did the right thing and tried to follow policy. I think where he erred is when Sandusky wasn't fully brought to charges and was still allowed to remain with the institution, he didn't take it a step further and threaten to tell the authorities. It was a messed up situation. I don't think all of the facts in this case have surfaced yet.

What about evidence tampering?

It didn't have to be some sort of beating, just walk in and announce your presence and tell him he had better stop. Trust me, I think he would have stopped and this whole mess would have had a better outcome all around.
