Your statement is what is so disappointing. No one should be so dogmatic about everything. LBBC is not a libertarian. He/She is someone who looks at an issue and decides on that issue alone, not some ideological stance that says every issue should be decided the same way. AND more importantly, there are no teams - it is not about winning and losing, it is about this issue. LBBC, I believe also wants the government to step in and keep women from having abortions, so LBBC is not on a team, LBBC makes decisions on issues. That is the way it always should be.

You're right about one thing. It's not about winning and losing. It's about the constitution and the bill of rights, and deciding issues based on the consttution. The protection of private property granted in the constitution and bill of rights.

 

If defending and protecting the constitution and bill of rights as they were written is idealogical, then I'm idealogical.

I wasn't calling anybody anything. I was defending LBBC about not simply holding one ideological world view but actually considering issues and then making decisions based on those issues. I don't remember private property being mentioned in the bill of rights, maybe the search and seizure amendment, but as a matter of fact the phrase the Jefferson stole from Locke changed "property" to the "pursuit of happiness" intentionally taking out the right to property. I do know that the Preamble (that my son had to memorize last night) does say that the government is to "promote the general welfare." I would think protecting workers and patrons of a business from second hand smoke is certainly promoting the general welfare.

 

FWIW I am sure that out there somewhere is an issue on which I fall conservatively. As long as the goal is taking care of people.

Where does it say in the bill of rights anything about you being able to eat out restaurant?

The answer is pretty simple: The antismoking people will not stop until smoking is against the law.

 

This has been the ultimate goal since day one.

 

Use the foot in the door approach. It always starts out as something simple and reasonable. "You shouldn't be able to smoke on flights under an hour." That is a reasonable request, hence we have a law banning smoking on flights of less than an hour. That has now escalated to no smoking in any building that serves the public.

 

Next your car, your home, then illegal to smoke.

 

You want to know why gun enthusiasts fight every attempt to impose any kind of restrictions on guns? Because they know the ultimate goal of the gun haters is to ban guns just like the ultimate goal of the antismoking people is to ban smoking.

 

For the record, I smoked for 20 years and quit 10 years ago.

 

It took me 10 days of thinking about this subject, but this is by far the best argument anyone has made about this. I personally wouldn't mind this law being passed because I frequent restaurants and bars and I'm a non smoker. I totally understand and agree with your argument here though so I hope for legal issues it doesn't. The reason KY is trying to get "lottery" games in race tracks is because they know it will eventually lead to slots, then other things and finally full fledged casinos. WV first had only slots and now they have full casinos. Indiana had casinos that had to be on water and even had to go out on the river when possible and now they have land based ones. I really hope KY eventually gets casinos and that doesn't have to do anything with this but I understand the foot in the door argument and it persuaded me to be against the smoking ban even though I would personally love it.

Kind of taking from SSC here. Nice post by the way. I would not be surprised when smoking while driving is banned. I would consider smoking while driving a car as much as a distraction as texting. How many time has an errant ash or lit butt flew back in the window, causing quite a distraction?
