Because when the act of killing a person is intentional and willful, it's murder. Manslaughter is a crime of either accidental killing or killing while under extreme emotional disturbance. If abortion were to be declared a crime, it couldn't be considered accidental.

 

Also interesting, the laws prohibiting fetal homicide in Kentucky as currently on the books, exempt any action taken by the mother. They are currently immune as the law is written.

 

This clause is what would keep it from being a murder charge. Not saying I agree, but there are many who argue that fetus does not equal person. Even if abortion became illegal, I would guess that this argument would still influence the category of the crime and the sentencing recommendations.

I think the U.S. Code says that if you do something outside of the United States that would be considered illegal in the United States, then you have still committed a crime.

Just playing Devils Advocate here. I think US laws are violated in other countries that have different laws every day, I can't see it being enforced.

 

 

Most people I know don't believe in abortion, and would never have one. However, most people I know also don't believe that someone should be charged with murder if they have one.

Currently there is no "that crime" as abortion is currently a legal act. If it were to becom illegal all aspects would be revisited and I highly doubt it would be viewed in the same was as if someone killed a pregnant woman and her unborn child.

What if the father agreed to the abortion? What if a mother took her daughter to the doctor for an abortion? What if a girl's best friend took her? What about the nurse who assisted? The anesthesiologist? The receptionist who booked the appointment?

 

If abortion is illegal I doubt we'd have a doctor, nurse, anesthesiologist and a receptionist there to assist.

Sure....The one actually killing the unborn baby is the doctor, therefore I see him as being guilty of actually executing the murder. With the mother, I see her as a willing accomplice to the murder, but unfortunately she didn't actually do the killing, so I can't justify a murder charge on her.

Most people I know would say abortion is murder and it would become illegal. Of course I live in a very conservative, fairly religious area so that may not be indicative of the rest of the country.

 

It's not indicative of the rest of the country. I'm pretty sure most people in this country want abortions to remain legal. Math might be able to post some statistics proving that.

What happens when a mafia boss hires a hit man? Who is charged there (if charges can be brought against them both)? It could be similar to that, with the mom being the boss and doc being the hit man.

Also just a note, I plan on going to medical school in 2 years and specializing in OB-GYN, I am interested to come across how they teach this subject at med school, or in your residency.

I'm gonna have to disagree with you for a very important reason. Even as late as 1970 when the Roe v. Wade action was first litigated, unwed mothers were still very much looked down upon. Women sought illegal abortions because their pregnancy put them in an ostracized class. Even after the Supreme Court laid down their decision in the Roe case, it still took years for abortion to become a tool of convenience. Since a large percentage of children are born out of wedlock, have bi-racial children, and/or are born with "repairable defects", I just don't see many women running to illegal abortion mills.

 

Besides, if we stop abortion, maybe there will be enough young people working to pay my Social Security and Medicare when I retire.

It's ok to disagree with me. I'm just telling you how it was before Roe v. Wade. I'm old enough to remember it. Mark my words you'll have people profit from this, if it is made illegal again, like just about everything else that is illegal.

 

People are going to get abortions whether it is legal or not.

IMO, it is a legal form of murder now. Premediated taking of a human life.
