Because a young girl is often times more of a victim than a young boy is. That is my whole point.

Nowadays, I'm not so sure. Maybe, I really don't know the answer to that. I still don't see any reason why the crime should be less accountable for a female committing the same crime. It's a double standard that needs to be removed.

Those of you that think the double standard is unfair, when you hear of a 35 year old with a 15 year old, do you honestly say your response (down in your gut) is the same based on who is the adult and who is the minor? Maybe I'm the only one, but I feel much differently when the minor is a girl.

Wrong is wrong. Why not just say all boys over 12 is fair game? Why make it a crime at all then? Heck, he can't get pregnant and Lord knows he can't have any emotional problems from it. Heck with him, tell him to just suck it up and enjoy.

It would never legally fly, but I think 14-17 year old boys make their own sexual decisions. For instance from the time I was between 14-17 none of my guy friends had to be talked into doing anyting like that. On the other hand girls had to be talked into things by us if that makes any sense. I don't remember any of my male friends making any girls "wait".

I don't agree with that at all, boys are much more immature in general and don't even think about what they're getting into. There are also a lot of young girls out there that can make a sailor blush.

That's a great point. We hear all the time that girls mature so much more quickly than boys. Physical readiness and emotional readiness are mutually exclusive terms which seems to get lost in the "Disparity" debate.

I think when looking at statutory rape, you are looking at the damage being emotional. The minor may willfully consent, but we argue they are too young to know the full ramifications of that consent, leading to further emotional damage in the short or long term. In that regard I think the damage is equal no matter the gender of the minor involved. Where the double standard exist, I believe, is through the physical act. A man can physically force a girl into the act, while a women, while possible, usually cannot do the same. So I believe we immediately feel the minor girl was most likely physically dominated while the minor boy was not. Of course that doesn't cover all of it. There is the societal view of men and women that does make the same crime seem harsher when perpetrated by a man, as well as the "where was that teacher when I was his age" mentality. What degree each factors into it, I don't know.

Thats not true at all.

First of all, personally I agree, it is wrong, no matter what.

 

However, socially, much more emphasis is put on the purity of our girls and protecting their innocence. In the meantime, "boys will be boys", wink, wink, has also been socially acceptable.

 

As long as history has gone on, young men having sex has been OK, while young women having sex is not....even though that math never worked out. Historically, men have been the "protectors" while women have had more passive roles in society. Fortunatly, with the womens rights movement, this is changing. Old views change slowly though.

 

Young men having sex with older women is often viewed as an adventure (The Graduate, Summer of 42, or more recently American Pie) Like it or not, that is the way society has viewed things forever. You would never see a movie glorifying a girl having such an adventure with an older man.

 

Though as a mother of both sexes, I am much more vigilant with my daughter than my boys. Boys dont suffer a bad reputation for having sex, nor do they get pregnant. When a pregnancy occurs, it is the girl who usually faces the bulk of the responsibility.

 

 

 

Until society as a whole changes that view, the courts wont either.

Pregnancy has zero to do with it. I won't simply repeat, verbatim, what BeechwoodFan posted, but I concur. Societally, girls are treated (and held) differently. Right or wrong, it is the way it is. Why do I feel differently when I hear the story? I guess I'm human. I guess I think little girls need to be protected. Maybe I'm old school. Pick one, I'm not sure. I know this, when I was 15, had I been put in this young man's position, I'm not sure I wouldn't have happily gone along with Mrs. Dinkel. That is a hormoneous (sp?) time for young boys.

Unless your in that position, you don't know do you? You don't know just how it would affect you at 14 or 15, male or female. I've no problem with protecting little girls, but why should we say the heck with the little boys?

Emotions should never come into play in the legal system, period. Either it's a crime or it isn't, it can't be both ways. What BeechwoodFan posted was nice and all, but it has absolutely no place in the courts. A crime is a crime, the punishment should be the same.
